TDC Equipment Sample Clauses

TDC Equipment. TDC, or its agent, may provide, install, maintain, repair, operate and control TDC’s equipment (“TDC Equipment”). TDC Equipment shall remain the sole and exclusive property of TDC, and nothing contained herein shall give or convey to Customer, or any other person, any right, title or interest whatsoever in TDC Equipment, notwithstanding that it may be, or become, attached to, or embedded in, realty. Customer shall not tamper with, remove or conceal any identifying plates, tags or labels identifying TDC’s ownership interest in TDC Equipment. Customer shall not adjust, align, attempt to repair, relocate or remove TDC Equipment, except as expressly authorized in writing by TDC; provided that, in the event of a TDC default in the performance of its obligations hereunder that causes a break or interruption in Service that has not been cured within an applicable cure period, Customer shall have the right to take reasonable steps, in consultation with TDC, to restore service.

TDC Equipment. TDC hereby leases to Customer any and all TDC Equipment named and identified in the Order Form(s) for use at such location and at such rental rate for approximately such time as is therein stated on such Order Form(s). Unless otherwise set forth in an Order Form, Customer hereby acknowledges and agrees that Customer shall be responsible for (and shall pay or reimburse TDC as applicable) all freight charges for the transportation of TDC Equipment to and from Customer and that, as between TDC and Customer, Customer bears the responsibility of any damage or loss incurred during the transportation process. In addition, Customer agrees to return all TDC Equipment in the same or reasonably sufficient packaging as such equipment was packaged and delivered to it.

  • New Equipment Where new types of equipment and/or operations, for which rates of pay are not established by this Agreement, are put into use after the ratification date of this Agreement within operations covered by this Agreement, rates governing such operations shall be subject to negotiations between the parties. This paragraph shall apply to all new types of equipment including office and clerical equipment. In the event an agreement cannot be reached within sixty (60) days after the date such equipment is put into use, the matter may shall be submitted to the National Grievance Committee for final disposition. Rates agreed upon or awarded shall be effective as of the date equipment is put to use

  • Safety Equipment Should the employment duties of an employee in the bargaining unit require use of any equipment or gear to insure the safety of the employee or others, the District agrees to furnish such equipment or gear.

  • Additional Equipment Additional Equipment may from time to time be added as the subject matter of this Agreement as agreed on by the parties. Any additional property will be added in an amendment describing the property, the monthly rental, security deposit, and stipulated loss value of the additional Equipment. All amendments must be in writing and signed by both parties. Other than by this amendment procedure, this Agreement may not be amended, modified, or altered in any manner except in writing signed by both parties.

  • Customer Equipment Customer represents and warrants that it owns or has the legal right and authority, and will continue to own or maintain the legal right and authority during the term of this Agreement, to place and use the Customer Equipment as contemplated by this Agreement. Customer further represents and warrants that its placement, arrangement, and use of the Customer Equipment in the Internet Data Centers complies with the Customer Equipment Manufacturer's environmental and other specifications.

  • Equipment The Fund shall obtain and maintain at its own cost and expense all equipment and services, including but not limited to communications services, necessary for it to utilize the Software and obtain access to the System, and Custodian shall not be responsible for the reliability or availability of any such equipment or services.
