TERM OF SETTLEMENT CONTRACT. 2 2. (a) This Settlement Contract shall become effective April 1, 2004, and shall 3 remain in effect until and including March 31, 2044: Provided, that under terms and conditions 4 mutually agreeable to the parties hereto, renewals may be made for successive periods not to 5 exceed 40 years each. The terms and conditions of each renewal shall be agreed upon not later 6 than 1 year prior to the expiration of the then existing Settlement Contract.

The terms and conditions of each renewal shall be agreed upon not later 142 than 1 year prior to the expiration of the then existing Settlement Contract. 143 (b) With respect to Project Water and the portions of this Settlement Contract 144 pertaining thereto, upon written request by the Contractor of the Secretary made not later than 1 145 year prior to the expiration of this Settlement Contract, whenever, account being taken of the 146 amount then credited to the costs of construction of water supply works, the remaining amount of 147 construction costs of water supply work which is properly assignable for ultimate return by the 148 Contractor as established by the Secretary of the Interior pursuant to (3) of Section 1 of Public 149 Law 643 (70 Stat. 483), probably can be repaid to the United States within the term of a contract 150 under subsection 9(d) of the 1939 Reclamation Project Act (53 Stat. 1187), the relevant portions 151 of this Settlement Contract may be converted to a contract under said subsection 9(d) upon terms 152 and conditions mutually agreeable to the United States and the Contractor. The Secretary shall 153 make a determination 10 years after the date of execution of this Settlement Contract, and every 154 5 years thereafter, of whether a conversion to a contract under said subsection 9(d) can be 155 accomplished pursuant to Public Law 643. Notwithstanding any provision of this Settlement 156 Contract, the Contractor reserves and shall have all rights and benefits under Public Law 643.

  • Term of Contract The term of this Contract shall be one (1) year commencing on the last date of approval by DIR and Vendor. Prior to expiration of the original term, DIR and Vendor may extend the Contract, upon mutual agreement, for up to three (3) optional one-year terms. Additionally, the parties by mutual agreement may extend the term for up to ninety (90) additional calendar days.

  • ADDITIONAL TERMS OF SETTLEMENT 22. This settlement is agreed upon in accordance with section 24.4 of MFDA By-law No. 1 and Rules 14 and 15 of the MFDA Rules of Procedure.

  • TERMS OF SETTLEMENT 26. The Respondent agrees to the following terms of settlement:

  • Term of Contract; Contract Extension The Contract will be in effect from the Effective Date (15 December 2016) through 31 December 2018. DAS, in its sole discretion, may extend this Contract for additional terms beyond the original term, prior to Termination or expiration, one or more times for a combined total period not to exceed the complete length of the original term.

  • Term of Master Agreement Section 10.1 is replaced in its entirety, as follows:

  • EXECUTION OF SETTLEMENT AGREEMENT 37. This Settlement Agreement may be signed in one or more counterparts which together shall constitute a binding agreement.

  • TERM OF MASTER CONTRACT The term of this Master Contract shall be from July 1, 2021 to June 30, 2022 (Title 5 California Code of Regulations section 3062(a)). Neither the CONTRACTOR nor the LEA is required to renew this Master Contract in subsequent contract years. The parties acknowledge that any subsequent Master Contract is to be re-negotiated prior to June 30, 2022. If the subsequent Master Contract has not been executed prior to June 30, 2022, this Contract shall remain in force and effect until terminated as provided herein or a new Master Contract is executed.

  • EFFECTIVE DATE OF SETTLEMENT 38. The Effective Date of this Settlement shall be the first business day on which all of the following shall have occurred or been waived:

  • Modification of Settlement Agreement Any modification to this Settlement Agreement shall be in writing and signed by the Parties.

  • Effective Date of Settlements ‌ Settlements reached at any step of the grievance procedure in this article, other than Clause 8.11, shall be applied retroactively to the date of the occurrence of the action or situation which gave rise to the grievance, but not prior to the effective date of the agreement in effect at the time of the occurrence or the date set by a board of arbitration.
