Terminated Space. Effective on the Commencement Date, the Premises shall be reduced to approximately 33,946 rentable square feet of space in the Building as shown on Exhibit A. Upon the later to occur of the Commencement Date or the Restroom Completion Date (as defined below), Tenant shall vacate and deliver full possession of the Terminated Space in the condition required by the Lease, including, without limitation, performance of Tenant’s restoration obligations. Tenant shall not have any rights, liabilities, or obligations under this Lease with respect to the Terminated Space for the period first accruing after the Commencement Date, except those that, by the provisions of the Lease, are intended to survive the expiration or termination of the Lease (specifically including, without limitation, the obligation to make a final reconciliation of Additional Rent owing for the Terminated Space, as required by the Lease).
Terminated Space. In the event Tenant elects to terminate less than all of the leased Premises in any Building, Tenant must (i) pay actual out-of-pocket costs of construction of all necessary demising walls (which walls shall be constructed by Landlord), (ii) continue to lease and occupy contiguous portions of the leased Premises in such Building (including contiguous floors, as applicable), and (iii) the Terminated Space must be of a size and layout to allow Landlord to reasonably re-lease such Terminated Space to a third party upon Tenant's vacation of the Terminated Space as mutually and reasonably agreed upon by Landlord and Tenant (and in no event will Tenant have the right to occupy less than half (Yz) of the rentable area on any floor partially occupied by Tenant, unless such occupancy is contemplated at initial occupancy of the Premises, and in no event will Tenant partially occupy more than one (1) floor, in any Building unless such partial occupancy is contemplated at initial occupancy, of the Premises). In no event may Tenant terminate this Lease with respect to any portion of the leased Building 1 Premises if Tenant continues to lease any portion of the Building 2 Premises. , (e)
Terminated Space. Effective as of 11:59 p.m. on May 31, 2001, the Original Premises shall be reduced by that portion of the Original Premises located on the tenth (10th) and thirteenth (13th) floors of the Building, consisting of approximately 12,922 rentable square feet and known as Suites 1001 and 1300 (collectively, the "Terminated Space"), and from and after May 31, 2001, the term "Premises" as used and defined in the Lease, as amended hereby, shall be deemed to mean and refer to 34,498 rentable square feet of office space on the 11th (Suite 1100) and 12th (Suite 1200) floors of the Building and being the Original Premises less the Terminated Space. On or before May 31, 2001, Tenant shall surrender, vacate and deliver possession of the Terminated Space to Landlord. Tenant shall surrender the Terminated Space in the condition required pursuant to Section 14 of the Lease. If Tenant fails to timely surrender and vacate the Terminated Space, then the provisions of Article 15 of the Lease shall apply to Tenant's holding over in the Terminated Space. Neither Landlord nor Tenant shall have any rights, estates, obligations or liabilities under the Lease with respect to the Terminated Space for that part of the Term accruing after May 31, 2001, except those which, pursuant to the provisions of the Lease, as amended hereby, expressly survive the expiration or termination of the Term (specifically including, without limitation, the obligation to make a final reconciliation under Article 4 of the Lease of the Additional Rent owing for the Terminated Space for calendar year 2001).
