Demising Walls. Walls separating the Premises from other storerooms shall be constructed with wood or metal studs or masonry at Landlord’s option with drywall, taped, spackled, ready for painting on all stud framed perimeter walls within the Premises except concrete and/or masonry walls, which shall include no framing, drywall or finishes. Firewalls and additional fire rating required due to Tenant’s use shall be installed by Tenant at Tenant’s sole cost and expense.
Demising Walls. In the event there are no demising walls separating the Subleased Premises from the Overleased Premises ("Demising Walls"), if such Demising Walls are required by the Xxxxxxxxx or any Legal Requirements, Sublandlord shall construct same and Subtenant shall pay to Sublandlord upon demand Subtenant's Proportionate Share of all cost incurred by Sublandlord in connection with the design, construction and permitting of Demising Wall. Notwithstanding the foregoing, if the cost of constructing Demising Walls which are required by the Xxxxxxxxx or any Legal Requirements is deemed by either party to be an excessive economic burden to such party based on the relation of such cost to the size of the Subleased Premises or the rental amounts provided for in this Sublease, such party may so notify the other party, and if such other party does not elect to pay the entire cost of the Demising Walls, this Sublease shall terminate within sixty (60) days of such notice. Nothing in the preceding sentence shall relieve Subtenant of the obligation to pay for the entire cost of Demising Walls if same are required as a condition to Sublandlord's consent to any assignment or subletting of this Sublease or the Subleased Premises by Subtenant. [XXX, LET'S DISCUSS THIS PROVISION.] If such Demising Walls are not required by the Xxxxxxxxx or Legal Requirements, either party may elect at its sole expense to have such Demising Walls constructed in compliance with the Xxxxxxxxx and applicable laws provided such Demising Walls are constructed entirely within the Subleased Premises and the construction thereof, if by Subtenant, does not adversely affect the remainder of the Overleased Premises, and, if by Sublandlord, does not adversely affect the Subleased Premises. Any such construction shall be done subject to the terms of the Xxxxxxxxx, including any consent requirements, and in accordance with applicable law. In the event that no such Demising Walls presently exist or are constructed, Subtenant agrees not to unreasonably interfere with the use of the Overleased Premises by Sublandlord or its affiliates, or any other subtenants of Sublandlord, and Sublandlord agrees not to unreasonably interfere with use of the Subleased Premises by Subtenant.
Demising Walls. Landlord and Tenant shall equally bear the cost of demising walls affecting the Premises. EXHIBIT J BUILDING STANDARD MATERIALS/SPECIFICATIONS
A. DOORS, FRAMES & HARDWARE TENANT SUITE ENTRY AND EGRESS DOORS Solid core maple veneer doors in a maple frame with 1'6" X 8'0" sidelight and building standard hardware. Door shall be full height 3'0" X 8'0" X 1 3/4" INTERIOR DOOR Solid core maple veneer doors in a pressed metal frame with building standard hardware. Door shall be full height 3'0" x 8'0" x 1 3/4". STAIN Stain veneer to match architect's (base building) sample. Landlord shall provide a stain veneer sample to Tenant's designer within ten (10) days after execution of the Lease. ENTRY AND EGRESS DOOR HARDWARE _______________________- full mortise, lever dead latch lockset with surface mounted ADA closer, two pair of heavy weighted hinges, Ives door stop and silencer. Metal shall be US 26 Polished Chrome or US32 polished stainless steel. Landlord shall provide the complete desired door hardware specification to Tenant within ten (10) days after execution of the Lease. INTERIOR DOOR HARDWARE Lever hardware with two pair of heavy weight hinges, Ives door stop and silencer.
B. BUILDING SAFE FIRE PROTECTION Hydraulically designed, light hazard wet sprinkler system throughout all common and tenant areas. Heads shall be concealed phantom type heads recessed in ceiling and centered in the 2' x 2' ceiling tile. The underground garage will be protected by a dry type sprinkler system. SMOKE DETECTORS, HEAT DETECTORS, REMOTE LED'S Smoke or heat detectors will be installed, where required using CPD-ID module 301-ID by Fire Control Instruments. FIRE ALARM HORN/STROBE Fire alarm strobes will be installed, where required.
C. CEILING 117 ACOUSTICAL TILE Acoustic ceiling tile shall be VSG Acoustical Frost 414 with 2' x 2' x 5/8" thick tegular edge. Tenant shall have the right to use an alternate ceiling specification in certain areas of the Premises, subject to Landlord's reasonable approval thereof. SUSPENSION GRID Grid shall be Chicago Metallic 716 white ceiling grid CEILING HEIGHTS 13'8" - slab to slab 9'6" - finished ceiling height in tenant space
D. Demising Walls. Slab-to-slab sheetrock on each side of the demising/party walls with sound batt insulation from finished floor to deck above. Minimum fire rating: 1 hour. Each wall shall be taped, spackled, sanded, prime-painted and ready to receive finish material. Demising wall cost is shared between tenants. Corridor walls are as described in and will be installed as described in the Building Plans and Specifications. In the case of demising walls between tenants, one-half of the wall is a tenant cost.
Demising Walls. Demising wall partitions shall be 1-hour rated extending from finished slab to deck (height varies) and shall be constructed with 5/8” type C gypsum wallboard screwed to both sides of 6” wide metal studs. Provide R-l1 fiberglass blankets in wall cavity floor to roof deck (UL Des. U-465), painted white with black cove base.
Demising Walls. Landlord shall install demising partitions between common lobbies, corridors, stairways, restrooms, and leased premises which shall be one-hour fire-rated and constructed of masonry or steel studs and 5/8" gypsum board. Such partitions shall extend from floor to underside of roof or floor construction above. No gypsum board to be installed on Tenant side of demising walls, corridors, and exterior walls. Make
Demising Walls. The demising walls which separate the Premises from other tenant areas and Common Areas will extend from the finished floor to the underside of the structural beam or roof deck. Gypsum board will be supplied and installed by Tenant at Tenant's expense.
Demising Walls. Building Standard demising walls, if required, will be provided to enclose Tenant's Premises.
Demising Walls. Landlord shall construct demising walls and add common area corridors in the locations depicted on Exhibit A attached hereto and incorporated herein by this reference, in order to convert the third floor of the Building from a single tenant floor to a muti-tenant floor. Tenant acknowledges that the foregoing work may cause some disturbances and disruptions for Tenant and that Tenant hereby waives any claims Tenant may have against Landlord, including without limitation any claim for constructive eviction, as a result of the disturbances and disruption which Tenant may experience due to the construction of the demising walls and common area corridors.
Demising Walls. The Initial Plans do not set forth the location of demising walls between the Tenant Spaces or between the Tenant Spaces and the Common Elements of the Phase II Mall (the "DEMISING WALLS"), which have not yet been finally determined. The location of the Demising Walls shall be determined jointly by Mall II Buyer and Developer as the parties identify Tenants for the retail and restaurant Tenant Spaces in two stages, described as follows:
(i) Upon final determination of the Common Area Plans by the parties, Mall II Buyer and Developer shall negotiate expeditiously and in good faith to develop a plan for the location of the Demising Walls that is consistent with the Initial Plans and/or the Final Construction Drawings and Specs, if the same have been agreed upon, identifying whether each Tenant Space will be occupied by a restaurant or retail tenant, showing the specifications and points of connection with the Tenant Space of all utilities required for each such Tenant Space and identifying the location of smoke walls (as the same may be modified in accordance with this Agreement, the "INITIAL DEMISING WALL PLAN"). Mall II Buyer and Developer shall agree upon an Initial Demising Wall Plan no later than six (6) months after the date of execution of this Agreement. In the event that Mall II Buyer and Developer, despite good faith efforts, have not agreed upon an Initial Demising Wall Plan by such date, the same shall constitute a Construction Delay (the duration of which shall be one (1) day for each day after said six (6) month period that the parties shall have failed to agree on an Initial Demising Wall Plan).
(ii) Upon the final determination of the Initial Demising Wall Plan, Mall II Buyer and Developer shall negotiate expeditiously and in good faith to supplement the same to show the location, consistent with the Initial Plans, of all Demising Walls (as the same may be modified in accordance with this Agreement, the "FINAL DEMISING WALL PLAN"). Mall II Buyer and Developer shall agree upon a Final Demising Wall Plan no later than one (1) year after the date of execution of this Agreement. In the event that Mall II Buyer and Developer, despite good faith efforts, have not agreed upon a Final Demising Wall Plan by such date, the same shall constitute a Construction Delay (the duration of which shall be one (1) day for each day after said one (1) year period that the parties have failed to agree on a Final Demising Wall Plan).
