Common use of Termination of Sick Leave Clause in Contracts

Termination of Sick Leave. 8.6.1 An employee who has been placed on paid or unpaid sick leave may return to duty at any time during the leave, provided that he/she is able to resume the assigned duties, and if the leave has been for more than twenty (20) working days, provided that he/she has notified the County Office of his/her return at least three working days in advance. An employee shall continue to receive seniority credit when on paid sick leave. 8.6.2 If, at the conclusion of all sick leave and additional leave, paid or unpaid, granted under this Section the employee is still unable to assume the duties of his position, he/she may be dismissed at the discretion of the County Office, and if so he/she will be placed on a reemployment list for a period of thirty- nine (39) months.
