Terms for Renegotiation. The service levels defined herein shall not apply for the duration of the stabilization period, 3 months following “Go Live” of a new implementation. XXXX shall notify Customers at least (60) days prior to the date of a proposed change to the service levels, provided that XXXX will only propose a change to the service levels no more than once a quarter. These changes may include the following: (1) additions or deletions in the Levels of Service (including Critical Levels of Service and Key Performance Measurements); (2) movement of Critical Levels of Service toward Key Performance Measurements as designated in Appendix AOn Demand Service Levels Grid or (3) changes to the Service Level percentage designations. Within the 30 days following the receipt of Customer's request for an addition or modification, XXXX shall propose a commercially reasonable tool or methodology to measure the Level of Service and to evaluate any impact of that Level of Service on the ability of XXXX to provide the Services. In the event an addition or modification in a Level of Service requires implementing a new tool, methodology or additional resources to measure that Level of Service, XXXX shall implement such addition or modification pursuant to the Service Level Agreement new requests at Customer’s expense. When adding a new Level of Service, if XXXX previously implemented this new tool or methodology for another Customer, Customer shall only pay the incremental costs associated with the tool or methodology.

  • Renegotiation of Agreement Either party to this Agreement may, within ninety (90) days prior to termination of this Agreement, present to the other party in writing proposed terms of a new or further Agreement and/or amendments to this Agreement, and a conference shall be held within twenty (20) days, or as otherwise agreed by the parties, at which time the parties will commence negotiations on the proposed amendments and/or terms of a new Agreement. Negotiations will be conducted in the spirit of good faith.

  • Modification or Renegotiation This agreement may be modified only by written agreement signed by the parties hereto. The parties agree to renegotiate the agreement if federal and/or state revisions of any applicable laws or regulations make changes in this agreement necessary.

  • Renegotiation The contract may be renegotiated at any time by the parties, based upon appropriate and reasonable changes in circumstances upon which the original terms of the contract were based.

  • DISPUTE RESOLUTION POLICY It is the policy of the Office of General Services’ New York State Procurement (NYSPro) to provide vendors with an opportunity to administratively resolve disputes, complaints or inquiries related to NYSPro bid solicitations, contract awards and contract administration. NYSPro encourages vendors to seek resolution of disputes through consultation with NYSPro staff. All such matters shall be accorded impartial and timely consideration. Interested parties may also file formal written disputes. A copy of NYSPro’s Dispute Resolution Procedures for Vendors may be obtained through the OGS website (xxxx://xxx.xx.xxx/BU/PC/BizInfo.asp), (click on Dispute Resolution Procedures).

  • Renegotiation or Modification The Parties agree to renegotiate this Agreement if federal and/or state revisions of any applicable laws or regulations make changes to this Agreement necessary. In addition to changes necessitated by law, DEO may at any time, with written notice to Grantee, make changes within the general scope of this Agreement. Such changes may include modification of the requirements, changes to processing procedures, or other changes as decided by DEO. Any investigation necessary to determine the impact of the change shall be the responsibility of Grantee. Modifications of provisions of this Agreement shall only be valid when they have been reduced to writing and duly signed and dated by all Parties.

  • NEGOTIATION PROCEDURE A. The parties agree to enter into collective negotiations over a successor Agreement in accordance with Chapter 303, Public Laws of 1968, and its amendments under Chapter 123, Public Laws of 1974, in a good faith effort to reach an agreement on matters concerning terms and conditions of employment for all employees covered by this Agreement. Such negotiations shall begin in accordance with PERC rules. Any Agreement so negotiated shall not be effective unless reduced to writing and signed by authorized representatives of the Board and the Association.
