Billing for any such approved additional services will be based on the actual number of hours at the guaranteed rate. All annual project fees listed are guaranteed through the term of the Contract. Above annual project fees are all-inclusive with no additional fees and include such items as travel, copies postage and other delivery charges, supplies, technology-related costs, such as computer processing, software licensing, research and library databases and similar expense items. T.H. I.S. From and out of the salary and pension payments of the Assistant Superintendent, as set forth hereinabove in paragraph 3, the Board shall withhold any such amount as may be required by law, on behalf of the Assistant Superintendent to the Teacher Health Insurance Security Fund.

The contractor shall also make necessary suitable arrangement for maintaining the quality and temperature of bituminous mix by covering hot mix with thick tarpoline during conveying or thermocol coating to conveying vehicle or any other suitable arrangement, so that quality and temperature will be maintained as specified at the time of laying bituminous hot mix. T.H. In case of damage, by fire or other action of the elements, to the building in which the leased premises are located, without the fault of Tenant or of Tenant's agent or employees, if the damage is so extensive as to amount practically to the total destruction of the leased premises or of the building, or if Landlord shall within a reasonable time decide not to rebuild, this lease shall cease and come to an end, and the rent shall be apportioned to the time of the damage. In all other cases where the leased premises are damaged by fire without the fault of Tenant or of Tenant's agents or employees, Landlord shall repair the damage with reasonable dispatch after notice of damage, and if the damage has rendered the premises untenantable, in whole or in part, there shall be an apportionment of the rent until the damage has been repaired. In determining what constitutes reasonable dispatch consideration shall be given to delays caused by strikes, adjustment of insurance and other causes beyond Landlord's control. Access to Premises. 7/th/. Tenant agrees that Landlord and Landlord's agents and other representatives shall have the right to enter into and upon said premises, or any part thereof, at all reasonable hours of the purpose of examining the same, or for making such repairs, alterations, additions or improvements therein as may be necessary or deemed advisable by Landlord. Tenant also agrees to permit Landlord or Landlord's agents to show the premises to persons wishing to hire or purchase the same; and Tenant further agrees that during the 6 months next preceding the expiration of the term hereby granted, Landlord or Landlord's agents shall have the right to place notices on the front of said premises, or any part thereof, offering the premises "To Let" or "For Sale," and Tenant hereby agrees to permit the same to remain thereon without hindrance or molestation.

The failure of Landlord to insist upon a strict performance of any of the terms, conditions and covenants herein, shall not be deemed a waiver of any rights or remedies that Landlord may have, and shall not be deemed a waiver of any subsequent breach or default in the terms, conditions and covenants herein contained. T.H. I.S. In addition to the salary and pension payments of ASSISTANT SUPERINTENDENT FOR TEACHING AND LEARNING, as set forth hereinabove in paragraphs 3 and 4, the Board shall pay any such amount as may be required by law on behalf of ASSISTANT SUPERINTENDENT FOR TEACHING AND LEARNING to the Teacher Health Insurance Security Fund ("T.H.I.S.”). If the current employee contribution rate required by T.H.I.S. to be remitted decreases or if legislation is implemented that limits the ability of the Board to fulfill its obligations under this section, the Board shall, to the extent permissible by law or regulation, pay the difference to the ASSISTANT SUPERINTENDENT FOR TEACHING AND LEARNING as salary to the extent the Board’s total cost for salary and pick up of the TRS contribution does not exceed the Board’s total cost before the TRS contribution rate decrease and/or legislative change.
