THE CONSTRUCTION CONTINGENCY. An agreed upon sum included in the GMP for the purpose of defraying the CONTRACTOR’s actual approved expenditures for changes requested by the CITY in the 90 percent Construction Documents or Specifications. Any costs to be applied against the contingency must first be approved by the CITY in writing. The CONTRACTOR will be required to furnish documentation evidencing the expenditures charged to this Contingency prior to release of funds by the CITY. At Final Completion of the Project, any remaining monies in the Construction Contingency shall vest in the CITY. The Guaranteed Maximum Price shall be reduced in the amount of the Construction Contingency remaining monies, if any.

THE CONSTRUCTION CONTINGENCY. An agreed upon sum included in the GMP for the purpose of defraying the CONTRACTOR’s actual approved expenditures due to unforeseen circumstances relating to the CONTRACTOR’s Direct Construction Costs, or to cover other costs arising during construction, such as: anticipated costs that exceed a particular line item within the Estimated Contractor's Direct Construction Cost; increases in subcontractor costs due to insolvency, preferred subcontractor cost differentials generated by CONTRACTOR’s selection of subcontractors (PROJECT MANAGER’s designation of preferred subcontractors shall be subject to the provisions of Article 11.2); payment of deductible amounts for loss covered by Builder’s Risk; and any other cost agreed to mutually in writing between the PROJECT MANAGER and CONTRACTOR. Any costs to be applied against the contingency must first be approved by the DIRECTOR at the recommendation of PROJECT MANAGER in writing. The CONTRACTOR will be required to furnish documentation evidencing the expenditures charged to this Contingency prior to release of funds by the CITY. At Final Completion of the Project, any remaining monies in the Construction Contingency shall vest in the CITY. THE CONSTRUCTION CONTINGENCY. 3.1.5.4 Estimates of the Contract Price shall not include: (1) Contractor’s Preconstruction Phase Services Fee; (2) the compensation of the A/E, the A/E’s mechanical, electrical, plumbing, structural, civil, and/or any other consultants and subconsultants; or (3) the costs of land, right-of-way, debt service or other costs which are the responsibility of DFCM.

  • Special Construction If, after an order is placed, Xxxxxxx finds that third-party special construction services are needed to build, configure or install any additional facilities and/or equipment necessary for Verizon to provide Access service, Verizon will notify the Customer of any such special construction charges. If Customer does not accept the special construction charges, Customer may terminate the order(s) affected by the special construction charges, with no cancellation fee(s).

  • DAF Construction The DAF shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Developer and Connecting Transmission Owner agree on another mutually acceptable deadline, the Developer shall deliver to the Connecting Transmission Owner and NYISO “as- built” drawings, information and documents for the DAF, such as: a one-line diagram, a site plan showing the Large Generating Facility and the DAF, plan and elevation drawings showing the layout of the DAF, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Developer’s step-up transformers, the facilities connecting the Large Generating Facility to the step-up transformers and the DAF, and the impedances (determined by factory tests) for the associated step-up transformers and the Large Generating Facility. The Developer shall provide to, and coordinate with, Connecting Transmission Owner and NYISO with respect to proposed specifications for the excitation system, automatic voltage regulator, Large Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • ICIF Construction The ICIF shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Parties agree on another mutually acceptable deadline, Interconnection Customer shall deliver to Transmission Provider and Transmission Owner “as-built” drawings, information and documents for the ICIF, such as: a one-line diagram, a site plan showing the Generating Facility and the ICIF, plan and elevation drawings showing the layout of the ICIF, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Interconnection Customer’s step-up transformers, the facilities connecting the Generating Facility to the step-up transformers and the ICIF, and the impedances (determined by factory tests) for the associated step-up transformers and the Generating Facility. Interconnection Customer shall provide Transmission Provider and Transmission Owner with Interconnection Customer’s specifications for the excitation system, automatic voltage regulator, Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • ADDITIONAL CONSTRUCTION The Promoter undertakes that it has no right to make additions or to put up additional structure(s) anywhere in the Project after the building plan has been approved by the competent authority (ies) except for as provided in the Act.
