Time for Performance; Force Majeure. This Agreement shall be effective upon the Effective Date. The City shall commence the Project promptly after execution of this Agreement, shall faithfully and diligently pursue work on the Project until its completion, and shall cause all work on the Project to be completed no later than December 31, 2024.

Time for Performance; Force Majeure. Unless specifically guaranteed in the Statement of Work, all statements regarding the time required to perform the Services and the dates by which those Services will be performed are estimates only. While BLUE KIWI will endeavor to complete the Services on the schedule mutually established with Client, BLUE KIWI makes no warranty that the Services will be completed by any given date.
Time for Performance; Force Majeure. Time is of the essence of this Master License and each Schedule. Notwithstanding anything in this Master License or any Schedule to the contrary, the time for performance for any term, provision, covenant, or obligation under this Master License or any Schedule will be deemed extended to account for any time lost due to delays that arise from strikes, civil riots, floods, labor, or material shortages or restrictions, governmental intervention, or any other cause not within the control of the party whose performance is due.

  • Time for Performance The term of this SOW Agreement shall begin on and end on _ (the “Initial Term”). The Initial Term may be extended as the parties may agree. The State may terminate this SOW for convenience upon thirty days prior written notice to the Contractor. If the Master Agreement should expire or otherwise terminate prior to the end of the term of this SOW Agreement, this SOW Agreement shall continue to the end of its existing term, unless or until terminated in accordance with the terms of this SOW Agreement, and the Parties acknowledge and agree that the terms of the Master Agreement shall survive and apply to this SOW Agreement.

  • Ongoing Performance Measures The Department intends to use performance-reporting tools in order to measure the performance of Contractor(s). These tools will include the Contractor Performance Survey (Exhibit H), to be completed by Customers on a quarterly basis. Such measures will allow the Department to better track Vendor performance through the term of the Contract(s) and ensure that Contractor(s) consistently provide quality services to the State and its Customers. The Department reserves the right to modify the Contractor Performance Survey document and introduce additional performance-reporting tools as they are developed, including online tools (e.g. tools within MFMP or on the Department's website).

  • Performance Schedule The Parties will perform their respective responsibilities in accordance with the Performance Schedule. By executing this Agreement, Customer authorizes Motorola to proceed with contract performance.

  • Performance Delay Time is of the essence in the Vendor’s performance of this Agreement. If at any time it appears to Vendor that it may not meet any of the performance schedules or the scheduled completion date of the services to be performed for any reason, including labor disputes, Vendor shall immediately by verbal means (to be confirmed in writing) notify Customer of the reasons for and the estimated duration of such delay. If requested by Customer, Vendor shall make every effort to avoid or minimize the delay to the maximum extent possible including the expenditure of premium time. Any additional cost caused by these requirements of Customer shall be borne by Vendor, unless the delay in performance arises out of causes beyond the control and without the fault or negligence of Vendor or its subcontractors within the meaning of the Cancellation- Default clause herein. The foregoing requirements are in addition to any of Customer’s other rights and remedies as may be provided by law or this Agreement.

  • KEY PERFORMANCE INDICATORS 10.1 The Supplier shall at all times during the Framework Period comply with the Key Performance Indicators and achieve the KPI Targets set out in Part B of Framework Schedule 2 (Goods and/or Services and Key Performance Indicators).
