Common use of Timeliness of Grievance Advancements and Responses Clause in Contracts

Timeliness of Grievance Advancements and Responses. Subsequent 5 grievance advancements and responses will be deemed untimely if the time 6 limits set forth above are not met, unless the parties mutually agree in good faith 7 to extend such time limits. The scheduling of a mutually agreeable meeting date 8 shall serve as such an extension. Such extension shall be documented in writing 9 if requested by either party. The parties shall make a good faith effort to meet 10 and/or respond at each step of the grievance process. If, however, a grievance 11 advancement is untimely, the Employer shall have the option of declaring in 12 writing that the grievance is automatically advanced to the next step in the 13 grievance process, or of notifying the grievant and the Association in writing of 14 such untimeliness. In the event the grievance is still not advanced to the next 15 step within five (5) days of such notification, the grievance shall be considered 16 settled on the basis of the last response to the grievance. If the Employer fails to 17 meet or answer any grievance within the applicable time limits, such grievance 18 shall automatically advance to the next step.
