Common use of Transfer of Services Clause in Contracts

Transfer of Services. Customer may not sublicense, assign, delegate or otherwise transfer its receipt of Services under this Agreement to a third party without Compute North’s written consent in its sole discretion. Compute North shall not under any circumstance be deemed to be providing any Services to any third party for or on behalf of Customer.

Customer may not sublicense, assign, delegate or otherwise transfer its receipt of Colocation Services under this Agreement to a any third party without Compute North’s express written consent consent, which Compute North may withhold in its sole discretion. In the event Compute North gives consent, Customer shall not remain fully responsible and liable to Compute North for the performance of all of Customer’s obligations under any circumstance this Agreement, and under no circumstances shall Compute North be deemed to be providing any Colocation Services to any third party for Customer or on behalf of Customerits behalf.
