Colocation Services. 3.1 Customer may, pursuant to and as described in a particular Sales Order Form, desire to sublease from Internap certain space (the “Space”) to locate certain equipment (the “Equipment”).
3.2 Customer shall use the Space solely for the location and operation of the Equipment. Customer shall not connect or interconnect the Equipment with any other equipment or services of any third party without Internap’s prior written consent. Except as set forth in the applicable SLA, the Space is accepted “AS IS” by Customer and Internap makes no representation or warranty as to the fitness of the Space for Customer’s intended use. Subject to Customer’s compliance with all standard and reasonable applicable clearance and authorization procedures, access to the Space shall be available twenty-four hours per day, seven days per week, but shall be limited to those employees of Customer identified to and approved by Internap in writing. If any employee of Customer causes any damage or threat of damage to any equipment, individual or the Space in Internap’s sole discretion, Internap may rescind such employee’s right to access in the Space. Internap shall have the right to access the Space at any time for any purpose, but shall not, except upon Customer’s request, have the right to use or access Customer-provided equipment. Internap shall have the authority (without subjecting Internap to any liability related thereto) to suspend Customer’s operations in and around the Space if, in Internap’s sole discretion, there arises any hazardous condition, unsafe practice or emergency situation. Internap may, upon reasonable notice, require Customer to relocate the Equipment to another space, provided, however, that such other space shall afford reasonably comparable access, environmental conditions and facilities. All reasonable costs of relocating the Equipment in the above circumstance shall be born by Internap.
3.3 Neither Customer nor its agents or contractors shall make any alterations or improvements to the Space prior to submitting all plans and specifications for such improvements to Internap and receiving Internap’s prior written consent. All fixtures, alterations, improvements and/or appurtenances attached to or built into, on or about the Space shall be and remain part of the Space and shall not be removed by Customer (unless otherwise directed by Internap). Colocation Services. Notwithstanding anything to the contrary in the MSA, Savvis may increase the rates associated with existing Colocation Service at any time after twelve months of the initial Installation Date for such Service, and no more than once every twelve· months, in order to pass through increases in such Service's underlying power facility costs and such increase shall be effective upon the date set forth in Savvis' written notice thereof to customer. The amount of any such rate increase shall be in proportion to the power utility cost increase approved by the applicable regulatory body. Customer or Customer's employees,agents, contractors, or End Users who access any Savvis data center or other Savvis facility (a "Savvis Premises") on Customer's behalf ("Authorized Representatives") must be designated in writing. Customer, its Authorized Representatives and all Customer Equipment and any related materials used in connection with the Service shall comply with all data center operating policies (including the "Savvis Customer Handbook and Information Guide" ("Customer Guide")), a current copy of which is located on xxx.XXXXXXxxxxxxx.xxx and which Savvis may change from time to time. If Savvis modifies its Customer Guide, except as required by law or regulation, or industry standard ("Customer Guide Change"L and the Service is materially and adversely affected by the Customer Guide Change, Customer may, within fifteen (15) business days of the date Savvis notifies Customer in writing of the Customer Guide Change ("Customer Guide Change Notice Period"), send written notice to Savvis indicating the Service affected and including details sufficient to demonstrate the adverse material effect on Customer ("Customer Guide Change Notice"). Savvis will, within thirty (30) days of receipt of the Customer Guide Change Notice, review the notice and notify Customer whether Savvis agrees or disagrees with Customer's assertion. If Savvis agrees that the Customer Guide Change materially and adversely affects the Customer use of Service, Customer Guide may agree to waive the applicability of the Customer Guide Change to Customer, provided that any such waiver shall not be made by Savvis until the parties execute an amendment to the Agreement setting forth the terms of the waiver. If Savvis does not agree to the waiver, Customer may thereafter accept such Customer Guide Change or, no later than five (5) business days from the date of Savvis' response, terminate the Services directly ...
Colocation Services. This Agreement is not intended for colocation services. Notwithstanding anything to the contrary in this Agreement, if colocation services are covered under this Agreement, Cox reserves the right, in its sole discretion, to terminate this Agreement (or any portion thereof) upon five (5) days’ written notice to Customer.
Colocation Services. Colocation services for web sites, Internet-based applications, including facilities, “ping, power and pipe” and other customary services.
Colocation Services. IDT agrees to provide Colocation Services to TI USA PORTAL, and, as further described on Exhibit "A," to provide certain other related services to TI USA PORTAL. As used herein, the term "Colocation Services" shall mean the hosting of sites on the World Wide Web portion of the Internet (the "Web Sites") for TI USA PORTAL and the provision of related services, all as described on Exhibit "A" attached hereto. IDT shall provide the Colocation Services so that each Web Site is accessible to third parties via the World Wide Web portion of the Internet as specified herein, and, in all cases, in conformity with all applicable laws, rules and regulations and the service levels set forth on Exhibit "A" attached hereto.
Colocation Services. The contractor undertakes to ensure the availability of cogeneration services in the form of electricity supplied to the output port of the customer's working power supply distribution unit ("Power Distribution Unit"). It includes uninterrupted system operation, power and distribution unit and cabling, but does not include power to the Customer's servers. Downtime for the Colocation Service begins when a particular server is down due to a power outage. Such availability is calculated on a monthly basis beginning with the first full calendar month of service. If the Contractor fails to fulfill its obligations under this section, and such failure materially adversely affects the performance of the Customer's servers, the Customer shall be entitled to a refund in accordance with the terms set forth below ("Refund"). Any compensation is calculated as a percentage of the monthly fee for the affected servers for the relevant month as follows: Availability Compensation <99.0% 5% for every half hour of service violation
Colocation Services. “Colocation Services” are Private Suite, Cage, Rack or Shared Colocation Services residing in a LightEdge data center.
4.1 Colocation Planned Maintenance Schedule: only performed between 12AM - 4AM Central Time Notification: minimum of three (3) week advance notification to Customer 4.2 Electrical Power SLAs. 4.3 Cooling & Humidification SLAs.
Colocation Services. The monthly recurring fee for the Colocation Services is specified in the CSA. The Colocation Services include the following:
1.1 Installation in a cabinet predetermined for your configuration;
1.2 Space in the cabinet;
1.3 Ventilation and power at the standard voltage supplied for all customers at the data center;
1.4 A single connection to the network together with a single public IP address which utilizes Network Address Translation on the private side of the required rack-mountable firewall;
1.5 Power cycling upon your request; provided that the power switch is external and physically accessible, does not require additional attachments, and does not require unlocking physical or logical security mechanisms;
1.6 Provided that a replacement device (“Spare”) has been delivered in accordance with Section 4 below, at your request, replacement of a failed Colocated Device and shipment to you. The Colocation Service does not include monitoring, patching, back-ups, hardware or software troubleshooting, escalation or software installation, upgrades or downgrades. You acknowledge and agree that you are responsible for the configuration, testing, monitoring and management of any Colocated Device unless you have contracted with us to provide those services separately.
Colocation Services. 3.2.1. Colocation Services means the provision of area and/or space including but not limited to any cabinets, cages, suites or rooms as well as the associated power supply, heating, ventilation, air conditioning, physical security and Remote Hands services made available to Vocall.
3.2.2. Vocall is responsible for all internal rack switching.
3.2.3. Vocall shall not allow any third party, including but not limited to, vendor support engineers, to work on the Vocall Equipment located at the Provider Facilities unless accompanied by the duly authorised Vocall representative.
3.2.4. The Provider shall notify Vocall in writing before execution of any work by it or its authorised representatives that may have an impact on the provision of the Services.
3.2.5. Vocall shall be responsible for the insurance of all Vocall Equipment located at the Provider Facilities.
3.2.6. Vocall permits the Provider to physically access the rack access to conduct random hardware compliance audits to ensure that the Vocall Equipment does not pose security risks or fire risks.
