Transferability of Warranty. The unexpired portion of this warranty may be transferred, provided that (i) the warranty has not been voided or breached by the transfer or prior to transfer, (ii) the appropriate Terex Construction Party has received warranty registration for the relevant Product and (iii) the transferee completes and returns to the appropriate Terex Construction Party the appropriate warranty transfer documentation which shall be provided on request. THIS WARRANTY IS EXPRESSLY IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED (INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) AND ALL OTHER OBLIGATIONS OR LIABILITY ON THE PART OF THE TEREX CONSTRUCTION PARTIES. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE LIMITED WARRANTY CONTAINED HEREIN. Transferability of Warranty. This warranty applies only to the original end-use purchaser and installation of these products in commercial or residential applications.
Transferability of Warranty. 4.1. This warranty is solely for the benefit of the original Consumer and is therefore not transferable. If at any time, the Panel is resold or has changed ownership; the Warranty shall be null and void.
4.2. You have the option to apply directly with AET for a Transferability Addendum to this warranty. The cost of this Transferability Addendum is 50% of the current list price of a Panel per Panel sold and installed (as per the original sales contract and Warranty Card). This application and payment must be returned in to AET within 90 days of the change in original ownership. We reserve the right to refuse any application.
Transferability of Warranty. The Limited Warranty that the Work and the System will be free from defects in material, construction and workmanship in ten (10) years following the Completed Installation is transferable when the Customer conveys or transfers the Property to another party. The Customer or the transferee must give notice, in writing, to Freedom Forever within twenty (20) days from the effective date of the conveyance or transfer. The transfer of warranty shall be effective only if the transferee agrees to be bound by the conditions and terms of this Agreement. The transfer of warranty shall be effective upon Freedom Forever’s receipt of the written notice from transferee agreeing to the terms and conditions of this Agreement.

Notwithstanding anything to the contrary in the Agreement, including, without limitation restrictions on assignment and transferability set forth in Section 16 of the Agreement, SPIRE hereby agrees and consents to HOKU’s transfer of the limited warranty set forth in Attachment B to the Agreement to a third party in connection with HOKU’s sale or transfer of the Products to such third party, provided that SPIRE is consulted in connection with the installation of the Products at such third party’s facility.
