Trial Period and Disqualification. An employee transferred or promoted to fill a permanent opening shall fill it on a trial basis for forty- five (45) work days; and if the employee's performance is satisfactory, the employee shall be continued in the position. If the employee's performance is not satisfactory during the trial period, the employee may request written reasons; and he shall be returned to his former position if it is still vacant. If it is not vacant, the employee shall be assigned to a comparable position, i.e., same, or as closest to the same, hours as the previous position from which they originally transferred. During the first thirty (30) work days of a trial period, an employee may make a written request and return to his/her former position if it remains open at that time. As defined by this section, “work days” shall be defined as days that the employee actually performs work, and does not include, for example, days off on workers compensation, sick leave, etc. A vacancy due to an employee returning to their previous position during a trial period shall be posted for a period of three (3) days, pursuant to the terms of this Agreement.
