Former Position. An employee on layoff status due to his/her position or work being eliminated as defined in Article 16 (Staff Reduction/Layoff) shall be recalled to the former position when that position is reinstated or when a position involving substantially the same duties and responsibilities is formed and for which he/she is qualified, provided that such recall is within three (3) years following the layoff.

Former Position. Any employee who is on a medical leave of absence, industrial insurance accident, sick leave or has exhausted his/her sick leave shall be granted his/her former position when released for work from a doctor, provided he/she is able to perform his/her work.
