TRPA. For the avoidance of doubt, Sections 1.3, 1.4 and 1.5 hereof relate solely to matters between WEX and Wyndham. Nothing herein shall alter the rights and obligations of WEX and Realogy under the TRPA.
TRPA. Based on current land use designations and definitions in the Plan Area Statement and TRPA Code, the proposed use could be either an “Amusement and Recreation Service” (Allowed Use) or a “Participant Sports Facility” (Special Use). Further, there could be an argument as to whether the project could be considered a Temporary Use, and possibly eligible for Qualified Exempt status. This task will include discussions with TRPA staff to determine the appropriate way forward in terms of TRPA permitting. Once the nature of the permit and its’ requirements are known, AEC will prepare the TRPA Project Review submittal package or Qualified Exempt package as appropriate, coordinate with TRPA and Client regarding payment of application fees, and process the package through to issuance of the TRPA conditional permit. AEC will also assist the TCPUD with satisfying conditions of approval and completing the process to issuance of the final TRPA permit.
