TUPE on Commencement. 2.1 In the event that the parties agree that the provision of the Services from the Effective Date shall constitute a relevant transfer for the purposes of TUPE, or the provision of the Services give rise to a relevant transfer by operation of law, the parties agree that sub-paragraphs 2.2 to 2.3 and paragraphs 3 and 4 shall apply.
