Unauthorized Use of Funds. Grantee shall use Grant Funds consistent with this Agreement and the approved Grant Activities. CalOptima retains the right to recover any and all Grant Award funds if it (or any of its regulators) determines that any portion of the Grant Award was not expended as provided under the terms of this Agreement or applicable federal and state laws, regulations, guidance and/or funding source requirements.
Unauthorized Use of Funds. If the Town Manager determines that funds have been spent on goods and/or services not authorized under this Agreement, reimbursement may not be authorized.

Neither DCS nor, to the knowledge of DCS, any director, officer, agent, employee or other person acting on behalf of DCS has accepted or received any unlawful contributions, payments, gifts or expenditures.
