UNAVAILABILITY OF PROPERTY. In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.

UNAVAILABILITY OF PROPERTY. In the event the Property is not available for use during booked dates due to reasons, events or circumstances beyond our control, we shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Owner shall have no further obligations or liabilities in any manner pertaining to this Agreement. Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability.

UNAVAILABILITY OF PROPERTY. In the event the property is not available for use during the rental term due to reasons, events or circumstances beyond the control of owner/owner’s representative, the owner/owner representative will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the guest. If such replacement property cannot be found and made available, owner/owner’s representative shall immediately issue a refund. The refund will be prorated based upon the number of nights the property was not occupied by guests. Whereupon this Rental Agreement shall be terminated and you and owner/owner’s representative shall have no further obligations or liabilities in any manner pertaining to this Rental Agreement.

UNAVAILABILITY OF PROPERTY. In the rare event that the Property is unavailable for any reason beyond Manager’s control including, without limitation, acts of God such as fire, water damage or natural disaster, and if Manager cannot secure comparable accommodations for Guest(s), Manager agrees to transfer 100% of the rental amount to another available agreed upon time period of Host’s choice, and this Agreement will thereupon be deemed transferred. If Manager and Host are unable to reach an agreement for an alternate time period, Manager agrees to issue a 100% refund within five (5) business days. Manager’s liability to Host/Guest(s) is limited to the deposit and/or rental amount paid by Host, under any and all circumstances.

If such replacement property cannot be found and made available, Caribe Tesoro shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and there are no further obligations or liabilities by either party in any manner pertaining to this Agreement.
UNAVAILABILITY OF PROPERTY. In the event the Property is not available for use during the Rental Term due to any reasons, events or circumstances, this Agreement shall be terminated and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement. Rental Agent reserves the right to refuse lodging or service to anyone.
