UNINSURED MOTORIST COVERAGE. INSURING AGREEMENT
1. Subject to the "limit" that applies, "we" will pay compensatory damages which an "insured" is legally entitled to recover from the owner or operator of an "uninsured motor vehicle" because of "bodily injury":
a. sustained by an "insured"; and
b. caused by an auto accident. The owner’s or operator’s liability for the "bodily injury" must arise out of the ownership, maintenance, or use of the "uninsured motor vehicle". "We" will not be bound by any settlement or judgment for damages that results from a suit that is brought against the owner or operator of an "uninsured motor vehicle" without "our" prior written consent.
2. As used in Part C, "insured" means:
UNINSURED MOTORIST COVERAGE. Under How Much We Pay, Limit Of Liability, item
a. is deleted and replaced by the following:
a. The "limit" shown in the Schedule above for Uninsured Motorist Coverage is the most "we" will pay for all damages sustained in any one auto accident. This "limit" applies regardless of the number of:
UNINSURED MOTORIST COVERAGE. Named Non-Owner Coverage applies to the named person only, under Insuring Agreement, the definition of "insured" is deleted and replaced by the following: As used in Part B, "insured" means:
UNINSURED MOTORIST COVERAGE. With respect to the coverage provided by this endorsement:
1. Under Exclusions That Apply To Uninsured Motorist Coverage, the following exclusion is added: "We" do not provide Uninsured Motorist Coverage for "bodily injury" sustained by any "insured":
UNINSURED MOTORIST COVERAGE. With respect to a "covered auto" for which a premium is shown in the Schedule above for Uninsured Motorist Coverage, under Exclusions That Apply To Uninsured Motorist Coverage, the exclusion for "bodily injury" sustained by any "insured" while "occupying" a "covered auto" while it is being used as a public or livery conveyance is deleted and replaced by the following: "We" do not provide Uninsured Motorist Coverage for "bodily injury" sustained by any "insured" while "occupying" the "covered auto" while it is being used as a public or livery conveyance. This includes but is not limited to any period of time that an "insured" is using the "covered auto" while logged into a "transportation network program" as a driver, with or without a passenger "occupying" the "covered auto". However, this exclusion does not apply:
1) to the use of the "covered auto" for a shared-expense car pool;
2) to the use of the "covered auto" for a volunteer or charitable activity for which:
UNINSURED MOTORIST COVERAGE. With respect to a "covered auto" for which a premium is shown in the Schedule above for Uninsured Motorist Coverage, under Exclusions That Apply To Uninsured Motorist Coverage, the exclusion for "bodily injury" sustained by any "insured" while "occupying" a "covered auto" while it is being used in commerce for the delivery or transport of food or other goods is deleted.
UNINSURED MOTORIST COVERAGE. INSURING AGREEMENT
1. sustained by an insured person;
2. caused by accident; and
3. arising out of the ownership, maintenance or use of an uninsured motor vehicle. Determination of whether an insured person is legally entitled to recover damages under this Part IV and the amount of damages will be made by judgment against us entered by a court with proper jurisdiction. Any legal action for benefits under this Part IV must be commenced against us prior to the expiration of the bodily injury statute of limitations in the state in which the vehicle accident occurred. When used in this Part IV:
1. Insured person or insured persons means:
a. you or a relative;
b. any person occupying a covered vehicle; and
c. any person who is entitled to recover damages covered by this Part IV because of bodily injury sustained by a person described in “a” or “b” above.
2. Property damage means:
a. physical damage to, destruction or loss of use of, a
b. physical damage to, or destruction of, any property owned by an insured person which is contained in the covered vehicle at the time of the accident.
3. Uninsured motor vehicle means a land motor vehicle or
a. to which no liability bond or policy applies at the time of the accident;
b. to which a liability bond or policy applies at the time of the accident, but the bonding or insuring company:
i. legally denies coverage; or
ii. is or becomes insolvent.
c. to which a liability bond or policy applies at the time of the accident but its limits of liability are less than the minimum limits of liability specified by the financial responsibility law of the state in which a covered vehicle is principally garaged;
d. to which a liability bond or policy applies at the time of the accident but its limits of liability are reduced by payments to persons, other than insured persons, injured in the accident to less than the limit of liability for uninsured motorist coverage;
e. whose operator or owner cannot be identified and which causes an accident resulting in bodily injury or property damage, to an
i. actual physical contact occurred between the uninsured motor vehicle and a covered vehicle; however, in the absence of physical contact, the injured insured person’s description of how the accident occurred must be corroborated by an eyewitness other than the injured insured person;
ii. the insured person, or someone on his or her behalf, reports the accident to the police or civil authority within twenty-four
UNINSURED MOTORIST COVERAGE. If you pay a premium for Uninsured Motorist Coverage, and it is shown on the declarations page:
a. when used in Part IV, the Additional Definition of insured person and insured persons is deleted and replaced by the following: Insured person or insured persons means:
i. you, when occupying a covered vehicle with the express or implied permission of the owner; and
ii. any person who is entitled to recover damages covered by Part IV, because of bodily injury to you. If you pay a premium for Uninsured Motorist Property damage Coverage, and it is shown on the Declarations page, any insurance we provide for Uninsured Motorist Property damage Coverage shall be excess over any other similar insurance, self-insurance, collision insurance or comprehensive insurance.
UNINSURED MOTORIST COVERAGE. If you pay a premium for Uninsured Motorist Coverage, and it is shown on the declarations page:
a. when used in Part IV, the Additional Definition of insured person and insured persons is deleted and replaced by the following: Insured person or insured persons means:
i. you, when occupying a covered vehicle with the express or implied permission of the owner; and
ii. any person who is entitled to recover damages covered by Part IV, because of bodily injury to
