UNION SECURITY AND CHECKOFF. A. Except as provided below, all Bargaining Unit Faculty covered by this Agreement, as set forth in Article 1.2(A), who do not voluntarily acquire and maintain membership in the Union, shall be required as a condition of continued employment to pay to the Union each month, beginning no later than thirty-one (31) days after the date of their first paycheck for teaching a credit-earning course or laboratory pursuant to their appointment as a Bargaining Unit Faculty member covered by this Agreement or after the ratification of this Agreement, whichever is later, an agency fee for teaching a credit-earning course or laboratory (a service charge as a contribution toward the cost of administration of this Agreement and representation by the Union). The amount of such agency fee shall be determined by the Union in accordance with applicable law, as percentage of full dues uniformly required to be paid as dues and initiation fees by those who choose to become members of the Union. Agency fees shall be deducted from compensation earned for teaching a credit-earning course or laboratory, i.e. not from compensation for administrative duties. B. Payment of union dues or agency fees, voluntary contribution to the SEIU Local 1021 Committee on Political Education (COPE), or contributions to a charitable organization selected from the following list approved by the College and the Union, may be made by all Bargaining Unit Faculty via the check-off procedure provided by this Article. C. Each payday that the Bargaining Unit Faculty non-ranked faculty member receives a paycheck for teaching a credit-credit earning course or laboratory, the College shall, during the term of this Agreement, deduct from Bargaining Unit Faculty member’s an non-ranked faculty member compensation for teaching a credit-earning course or laboratory, a sum of dues or fees owed to the Union for the month covered by that paycheck and authorized under federal labor law, provided the Bargaining Unit Faculty non-ranked faculty member has furnished the College a written assignment executed in accordance with the law. The Union will provide the College a suitable form for the authorization of this payroll deduction and as to non-ranked faculty member and for new unit employees, the College will include that form with his/her hire paperwork. If the non-ranked faculty member has not submitted the authorization form by the time of his or her first paycheck, the deduction shall be made twice from his or her second paycheck.
D. The College shall remit the dues or fees to the Union along with a list of members and agency fee payers within the first ten (10) working days of the month following the month of collection.

The Union agrees that it will indemnify and hold Manhattan School of Music harmless from any damages and/or costs and expenses sustained by reason of any action taken by the School as dues and initiation fees by those who choose to become members a result of the Union. Charitable organizations include: Lasallian VolunteersIt is agreed that Manhattan School of Music shall assume no financial or other obligation arising out of the provisions of this Article except as specifically provided in this Article, East Bay Scholarship Fundand the Union hereby agrees that it shall indemnify and hold Manhattan School of Music harmless from any claims, De Marillac Academyactions, Lasallian Education Fundor proceedings by a faculty member arising from deductions made by Manhattan School of Music hereunder or from the enforcement of this Article. Once the deductions are remitted to the Union, De La Salle Blackfeet Indian School (Montana)their disposition shall be the sole and exclusive obligation of the Union.
C. Section 3: Each payday that the Bargaining Unit Faculty member receives a paycheck for teaching a credit-earning course or laboratorypayday, the College shall, during the term Manhattan School of this Agreement, Music shall deduct from Bargaining Unit Faculty each faculty member’s compensation for teaching a credit-earning course or laboratory, wages a sum of dues or and/or fees owed to the Union for the month covered by that paycheck and authorized under federal labor law, provided the Bargaining Unit Faculty faculty member has furnished the College Manhattan School of Music a written assignment executed in accordance with law. The Union shall provide to Manhattan School of Music a suitable form for the law.
D. The College authorization of this payroll deduction and as to new faculty, Manhattan School of Music shall include that form in his/her initial employment packet. Manhattan School of Music shall remit the dues or and/or fees to the Union along with a list of members and agency fee payers within the first ten or its duly authorized representatives not later than fifteen (1015) working days after the end of the month following in which the month deduction is made. The Union shall be responsible for obtaining executed written assignments from existing faculty. Following the receipt of collectionany checkoff revocation, Manhattan School of Music shall notify the Union, in writing, of the revocation.

The deduc- tion shall be made in the first paycheck of the month. The University agrees to transmit the dues and agency fees deducted to the Union by the tenth (10th) day of the following month. The Union shall have the exclusive right of dues and agency fee payers within checkoff for all adjunct or part-time faculty covered by the first ten Agreement. In order for the deductions to be made, the authorization cards must be received by the University's designated representa- tive by the fifteenth (1015th) working days day of the month following preceding the month when the checkoff is to begin. The University is not required to make retroactive deductions if an employee is out on an unpaid leave of collectionabsence or other unpaid status. The Union will provide to the University a suitable form, signed by an adjunct or part-time faculty, for the authorization of payroll deductions. The Union will provide to the University a dues authorization form suitable to be transmitted electronically by the University to adjunct faculty after hire.
