Unit Train Sizes. Buyer shall use Commercially Reasonable Efforts to provide Unit Trains which have a capacity equal to the Basis and within the Approximate Size. However, if Buyer knows, or with the reasonable exercise of diligence, should have known that a Unit Train will have a capacity greater or less than the Approximate Size, Buyer shall promptly give Seller written notice thereof. Seller shall have a reasonable period of time, but no more than five (5) Business Days after receipt of notice, to object to such variance. If Seller objects, Buyer and Seller shall use Commercially Reasonable Efforts to address the issue.
