US Citizenship. The Borrower will at all times maintain its status as a “citizen of the United States” as defined in Section 40102(a)(15) of Title 49 and as that statutory provision has been interpreted by the DOT pursuant to its policies.
US Citizenship. Any Security Party owning a United States flag Vessel ceases to be a United States of America citizen within the meaning of Section 2 of the United States Shipping Act of 1916, as amended, qualified to operate vessels in the coastwise trade; or
US Citizenship. As of the date of this Agreement and as of immediately prior to the Closing, the Company and, except as set forth on Section 3.22 of the Seller Disclosure Letter, each other Acquired Entity, is a U.S. Citizen. As of the date of this Agreement the Seller is, and following the Closing will continue to be, a U.S. Citizen.
US Citizenship. The Owner Trustee is a citizen of the United States (as defined in 49 U.S.C. Section 40102(a)(15)) and is eligible to register the Aircraft with the Federal Aviation Administration pursuant to Part 47 of the Federal Aviation Regulations.
US Citizenship. Each of the Owners is qualified on the date hereof to own and document its respective Vessel under the U.S. flag pursuant to 46 U.S.C. § 12102(a), as amended, with a registry endorsement.
US Citizenship. Applicants must declare U. S. Citizenship or submit evidence of eligible immigration status for each family member in accordance with Section 214 of the Housing and Community Development Act of 1980, as amended. Households that have no members with citizenship or eligible immigration status do not qualify.
US Citizenship. Lessor at all times will be a Citizen of the United States to permit registration of the Aircraft with the FAA. Trust Company represents and warrants that it is a Citizen of the United States. Owner Trustee represents and warrants that it is a Citizen of the United States.
US Citizenship. To the Knowledge of Airborne, as of the date hereof and immediately prior to the Effective Time, each of Airborne and Airco is a United States Citizen and is an “air carrier” within the meaning of Title 49, operating pursuant to the terms of one or more certificates of public convenience and necessity duly issued to it by the DOT, which certificates are in full force and effect and are adequate for the conduct of the business that Airborne or Airco is conducting.
US Citizenship. AirTran shall be a “citizen of the United States,” as contemplated by United States aviation law.
