Use of Aggregate or Anonymized Data. Notwithstanding anything else in this Agreement or otherwise, Dynatrace may, in accordance with Applicable Privacy Laws, monitor use of the SaaS Subscription by its customers and use the data in the aggregate in the pursuit of its legitimate commercial interests, including for industry analysis, benchmarking, analytics, and marketing. Customer agrees that Dynatrace may collect, use and disclose such information that does not incorporate Customer Data or Personal Information, or otherwise identify Customer or its Users.

Use of Aggregate or Anonymized Data. You acknowledge and grant us, and our Affiliates a non- exclusive right, in accordance with applicable Pri- vacy Laws, to monitor Your use of the Platform and collect, use, and disclose the data generated by such use in the aggregate for the following purposes: analysis, analytics, statistical evaluation about mar- ket overview and developments (“Benchmarks”) and for the further development and improvement of our products and services. We will ensure that such use does not incorporate Customer Data or Personal Information, or otherwise identify You or Your Authorized Users, or allow any access to or ability to reverse engineer to access any Personal Data or to be able to identify or draw conclusions about specific customers, projects or persons. We may distribute and/or publish Benchmarks to third parties. The rights of use granted by this clause are non-ex- clusive, free of charge, perpetual and may be trans- ferred by Us to Our relevant business units respon- sible for the operation of the respective Platform functions with third parties.
