Use of City Right of Way. The Secretary shall have the right to utilize any land owned or controlled by the City, lying inside or outside the limits of the City as shown on the final Design Plans, for the purpose of constructing the Project.

Use of City Right of Way. The Secretary shall have the right to utilize any land owned or controlled by the City, lying inside or outside the limits of the City as shown on the final Design Plans, for the purpose of constructing and maintaining the Project. Neither the Secretary nor the FHWA shall participate in the cost of the City’s Right of Way or easements, unless the Secretary determines the City will incur an unnecessary hardship. The City shall execute the appropriate deeds and easements transferring its property rights to the Secretary. Further, the City acknowledges the execution and transferring of the deeds and easements by the City to the Secretary is an obligation of the City for this Agreement and Construction of the Project.

If so requested, Xxxxxxxx acknowledges the execution and transferring of the deeds and easements by Xxxxxxxx to the Secretary is an obligation of Winfield for this Agreement and Construction of the Project. This obligation includes if the Commission requests the Cities execute the appropriate deeds and easements transferring the Commission’s property rights to the Secretary.

If so requested, Arkansas City acknowledges the execution and transferring of the deeds and easements by Arkansas City to the Secretary is an obligation of Arkansas City for this Agreement and Construction of the Project. This obligation includes if the Commission requests the Cities execute the appropriate deeds and easements transferring the Commission’s property rights to the Secretary.

  • Right of Way 8.1 The Site The site of the Project Highway (the “Site”) shall comprise the site described in Schedule-A in respect of which the Right of Way shall be provided by the Authority to the Contractor. The Authority shall be responsible for:

  • Special/temporary right of way The Contractor shall bear all costs and charges for any special or temporary right of way required by it in connection with access to the Site.   • RIGHT OF FLIGHT Authority reserves, for the use and benefit of the public, a right of flight for the passage of aircraft in the airspace above the surface of the real property owned by Authority, including the Premises, together with the right to cause in said airspace such noise as may be inherent in the operation of aircraft, now known or hereafter used, for navigation of or flight in said airspace, and for the use of said airspace for landing on, taking off from or operating on Airport. Company expressly agrees for itself, its successors and assigns, to restrict the height of structures, objects of natural growth and other obstructions on the Premises to such a height so as to comply with Federal Aviation Regulations, Part 77 and Authority zoning. Company further expressly agrees for itself, its successors and assigns, to prevent any use of the Premises or Common Use Areas that would interfere with or adversely affect the operation or maintenance of Airport, or otherwise constitute an Airport hazard.

  • CITY RIGHTS This document does not impose an obligation on the City to:

  • County Data Nothing in this Agreement will be construed to waive the requirements of § 205.009 of the Texas Local Government Code.

  • Right of Use The DATA SUBJECT retains her/his right to decide on the use of the DATA provided. The CONFIDENTIAL INFORMATION provided is and remains the property of the PROVIDER.

  • COUNTY RIGHTS a. All County rights and functions, except those which are expressly abridged by this Agreement, shall remain vested with the County.
