Common use of Use of Files Clause in Contracts

Use of Files. The Board shall not base any adverse action against an employee upon materials which are contained in such employee’s file unless said materials were placed in the files at the time the administration knew of the incident giving rise to such materials and the employee had been notified at such time that materials were being placed in the file.
