Common use of Use of Records of Employees Clause in Contracts

Use of Records of Employees. The record of an employee shall not be used against the employee at any time after eighteen (18) months following suspension or disciplinary action, including letters of reprimand or any adverse reports, providing the employee has no letter of reprimand or other disciplinary action for a full eighteen (18) month period. Notwithstanding the foregoing paragraph, letters of reprimand or disciplinary action placed in an employee's personnel file as a result of an incident involving the safety of a child shall remain for a period of forty-eight (48) months.
