Common use of Vacant Higher Level Position Clause in Contracts

Vacant Higher Level Position. Whenever Management assigns an employee on a temporary basis to perform the duties of a vacant higher level position (in a class for which the duties and responsibilities of the current class would provide qualifying experience for the higher level class*), such employee shall become eligible for additional compensation on the first day of said assignment.

Whenever Management assigns an employee on a temporary basis to perform the full range of duties of a vacant higher level position (in a class for which the duties and responsibilities of the current class would provide qualifying experience for the higher level class*), such employee shall become eligible for additional compensation on the first day of said assignment. In the event that said assignment exceeds 30 consecutive calendar days, Management will initiate action to appoint a qualified employee to said position. *Management will not assign higher level duties to an employee who does not meet the criteria.
