Vacation Time Vacation Pay. 14.01 Employees shall be eligible for unpaid vacation time between January 1st and December 31st of each calendar year, to be scheduled pursuant to the Employee’s and the Employer’s mutual agreement. Vacation time will be granted to Employees at the start of employment or January 1st of each year. Vacation time granted for Employees whose first day is mid-year will be prorated proportionally to the time remaining in the calendar year. 14.02 Accrued but unused vacation time may not be carried over from one year to the next, nor are any Employees eligible for pay in lieu of vacation time. 14.03 Annual vacation time will be granted according to the following schedule based on years of employment: Less than (5) years… Two (2) weeks. Between five (5) years & less than ten (10) years… Three (3) weeks. More than ten (10) years… Four (4) weeks. 14.04 Employees shall accrue vacation pay at a percentage of their qualifying gross earnings to be paid out at the sooner of vacation time taken or on the first payroll period of each calendar year: Less than (5) years… Four percent (4%). Between five (5) years & less than ten (10) years… Six percent (6%). More than ten (10) years… Eight percent (8%). Employees may not request accrued vacation pay be paid in excess of equivalent time taken. It is understood that Employees who are taking more vacation time than has accrued in equivalent pay will only be paid during their vacation time up to the maximum of accrued vacation pay. Vacation pay paid on the first payroll period of each calendar year will be issued as a separate deposit. Upon termination of an Employee’s employment, accrued and unpaid vacation pay will be paid to the Employee with their final payment. 14.05 Vacation requests must be submitted to the Employer in writing by the Employee a minimum of three (3) weeks prior to the requested start date of the vacation time. Alternatively, the Employee may submit vacation requests a minimum of three (3) weeks prior to the requested start date of the vacation time online via the Employee Self-Service website, The Employer will make reasonable efforts to accommodate requests, however, the Employer may at its sole discretion, decline a vacation request if the Employer deems that allowing the requested vacation time would interfere with the proper servicing of the client. Vacation requests which exceed granted vacation time as identified in Article 14.03 may not be approved by the Employer. If any Employee disregards a denied vacation time request, and does not report for work, their employment may be terminated for cause and without recourse under this Collective Agreement or the Legislation. 14.06 The Employer will make every reasonable effort to respond to vacation time requests within seven (7) calendar days of the submission date. Requests which have not received a response are not to be considered as approved. 14.07 Purchasing of travel accommodations/tickets will not be grounds for automatic approval by the Employer of any requests Vacation Time.
