Violence in the Workplace. (a) The parties agree that violence shall be defined as any incident in which an employee is abused, threatened or assaulted while performing his or her work. The parties agree it includes the application of force, threats with or without weapons and severe verbal abuse. The parties agree that such incidents will not be condoned. Any employee who believes he/she has been subjected to such incident shall report this to a supervisor who will make every reasonable effort to rectify the situation. For purposes of sub-article (a) only, employees as referred to herein shall mean all employees of the Employer notwithstanding Article 2.12. (b) The Employer agrees to develop formalized policies and procedures in consultation with the Joint Health and Safety Committee to deal with workplace violence. The policy will address the prevention of violence and the management of violent situations and support to employees who have faced workplace violence. These policies and procedures shall be communicated to all employees. The local parties will consider appropriate measures and procedures in consultation with the Joint Health and Safety Committee to address violence in the workplace, which may include, among other measures and procedures: i) Alert employees about a person with a known history of aggressive and responsive behaviours and their known triggers by means of: A) electronic and/or other appropriate flagging systems, B) direct verbal communication / alerts (i.e. shift reports), ii) Communicate and provide appropriate training and education, iii) Reporting all incidents of workplace violence, iv) Long-term care home wide violence risk assessments. (c) The Employer will report all incidents of violence as defined herein to the Joint Health and Safety Committee for review. (d) The Employer agrees to provide training and information on the prevention of violence to all employees who come into contact with potentially aggressive persons. (e) The Hospital will notify the Union in writing of all incidents related to violence within 4 days. For critical injuries the employer will notify the Union immediately and in writing within 48 hours. Such notices will contain all of the information as prescribed in Section 5 of the health care regulation. (f) The Hospital shall provide for reasonable repair or replacement cost for damage to an employee’s personal belongings (clothing, watch, glasses, contact lenses and prosthesis; jewellery is excluded with the exception of plain wedding bands) directly attributed to an assault while performing her work. It is understood that reimbursement shall be subsequent to completion of a Hospital Unusual Occurrence Report and the employee’s provision of a receipt. The employee will endeavour to present her or his claim to the Hospital within seven (7) days after the event, unless it was not possible for her or him to do so during this period. (g) The Hospital agrees to provide training and information on the prevention of violence to all employees nurses who come into contact with potentially aggressive persons. This The training will be done during a new employeenurse’s orientation first three (3) months of work and updated as required. The local parties will consider appropriate measures and procedures in consultation with the Joint Health and Safety Committee to address violence in the workplace, which may include, among other measures and procedures: i) Alert employees about a person with a known history of aggressive and responsive behaviours and their known triggers by means of: A) electronic and/or other appropriate flagging systems, B) direct verbal communication / alerts (i.e. shift reports), ii) Communicate and provide appropriate training and education, iii) Reporting all incidents of workplace violence, iv) Long-term care home wide violence risk assessments. (c) The Employer Hospital will ensure that there is a procedure to report all incidents of violence as defined herein to the Joint Occupational Health and Safety Committee for reviewCommittee. (h) The Hospital shall provide for reasonable repair or replacement cost for damage to an employee’s personal belongings (clothing, watch, glasses, contact lenses and prosthesis; jewellery is excluded with the exception of plain wedding bands) directly attributed to an assault while performing her work. It is understood that reimbursement shall be subsequent to completion of a Hospital Unusual Occurrence Report and the employee’s consent, provision of a receipt. The employee will endeavour to present her or his claim to the Employer will inform the Union Hospital within three seven (37) days of any employee who has been subjected after the event, unless it was not possible for her or him to violence while performing his/her work. Such information information, providing details set out in Section 5 of the Regulation for Health Care and Residential Establishments, shall be submitted in writing to the Union as soon as practicablepossible but in no case longer than four (4) days of becoming aware. (f) The Hospital will consider requests for reimbursement for damages incurred to the nurse’s personal property, such as eyeglasses, ripped uniforms, personal clothing, as a result of being assaulted while performing his or her work. (g) The Employer and the Union recognize that, where preventative measures have been unsuccessful to prevent violent incidents, counselling and support will be available to help victims recover from such incidents when possible.

Such a system shall include flagging measures which may include: i) Information about individual residents’ triggers. ii) Pre-admitting checklist. iii) Computerized record of resident’s history of violence. iv) Readily visible signage on the outside of the resident chart. v) Visible notation on the face sheet of the resident chart. vi) Signage for resident room doors. vii) Signage at bedside if multiple occupancy room and, viii) A method to communicate pertinent information about a resident and associated visitors to all employees. Violence in the Workplace. (a) The parties agree that violence shall be defined as any incident in which an employee is abused, threatened or assaulted while performing his or her work. The parties agree it includes the application of force, threats with or without weapons and severe verbal abuse. The parties agree that such incidents will not be condoned. Any employee who believes he/she has been subjected to such incident shall report this to a supervisor who will make every reasonable effort to rectify the situation. For purposes of sub-article article (a) only, employees as referred to herein shall mean all employees of the Employer notwithstanding Article 2.122.06. (b) The Employer agrees to develop formalized policies and procedures in consultation with the Joint Health and Safety Committee to deal with workplace violence. The policy will address the prevention of violence and the management of violent situations and support to employees who have faced workplace violence. These policies and procedures shall be communicated to all employees. The local parties will consider appropriate measures and procedures in consultation with the Joint Health and Safety Committee to address violence in the workplace, which may include, among other measures and proceduresremedies: i) Alert employees about a person with a known history of aggressive and responsive behaviours and their known triggers by means of: Aa) electronic and/or other appropriate flagging systems, Bb) direct verbal communication / communication/alerts (i.e. shift reports), ii) Communicate and provide appropriate training and education; and, iii) Reporting all incidents of workplace violence, iv) Long-term care home wide violence risk assessments. (c) The Employer will report all incidents of violence as defined herein to the Joint Health and Safety Committee for review. (d) The Employer agrees to provide training and information on the prevention of violence to all employees who come into contact with potentially aggressive persons. This training will be done during a new employee’s orientation and updated as required. (e) Subject to appropriate legislation, and with the employee’s consent, the Employer will inform the Union within three (3) days of any employee who has been subjected to violence while performing his/her work. Such information shall be submitted in writing to the Union as soon as practicable. (f) The parties agree that if the incidents involving aggressing client action occur, such action will be recorded and reviewed at the Occupational Health and Safety Committee. Reasonable steps within the control of the Employer will follow to address the legitimate health and safety concerns of employees presented in that forum. It is understood that all such occurrences will be reviewed at the Resident Care Conference.

(g) The Employer, in consultation with the JHSC or health and safety representative, shall develop an effective written measure and procedure to put in place a visible warning system for all employees who may be exposed to residents who have a history of violence or responsive behaviors. Such a system shall include flagging measures which may include: i) Information about individual residents triggers; ii) Pre-admitting checklist; iii) Computerized record of resident’s history of violence; iv) Readily visible signage on the outside of the resident chart; v) Visible notation on the face sheet of the resident chart; vi) Signage for resident room doors; vii) Signage at bedside if multiple occupancy room and; viii) A method to communicate pertinent information about a resident and associated visitors to all employees. Training on these measures and procedures will be developed, established and provided in consultation with the JHSC or health and safety representative in workplaces with six (6) – nineteen (19) employees.

This shall not prevent the Employer from removing the employee from the workplace until such time a Xxxxxxx is available. The employee shall be required to attend the meeting once the Xxxxxxx is available. (c) No disciplinary action may be taken in violation of paragraphs (a) or (b) and any such action will be invalid. (d) Where the Employer disciplines an employee, the discipline shall be in writing, and will include the Employer’s reason for such discipline, and a copy of the document shall be given to the employee and a copy will be forwarded to the Union.

Violence in the Workplace. The Employer and the Union recognize the need for a safe working environment free of violence or threats of violence. Violence is defined as the attempted or actual exercise by a person of any physical force so as to cause injury to an employee and includes any threatening statement or behaviour which gives an employee reasonable cause to believe that they are at risk of injury. (e) Subject to appropriate legislationWhen an employee has suffered as a result of violence, if a UPN member, the Local President or designate or head xxxxxxx of the UPN, or if a BCNU member, the chief xxxxxxx or designate of the BCNU, and with the employee’s consentappropriate Union, the Employer will inform the Union within three (3) days of any employee who has been subjected to violence while performing his/her work. Such information shall be submitted in writing to the Union notified as soon as practicableis reasonably possible. (f) Immediate critical incident stress debriefing and post traumatic counseling shall be made available for employees who have suffered as a result of violence. Leave required to attend such debriefing or counseling sessions will be without loss of pay. The xxxxxxx referred to in (e) and the Union office will be notified by the Employer where an employee is referred for such debriefing or counselling.

This training will be done during a new employee’s orientation and updated update staff annually or as required.per legislation (e) Subject The Hospital will ensure that all reports of assaults resulting in injury are reported to appropriate legislationthe Workplace Safety and Insurance Board (WSIB) in accordance with WSIB policy. (f) The Hospital, and with the employeenurse’s consent, the Employer will inform the Union Bargaining Unit President or designate within three (3) days of any employee nurse who has been subjected to violence assaulted while performing his/her work. Such information shall be submitted in writing to the Union as soon as practicablepossible. (g) The Hospital shall provide for reasonable repair or replacement cost for damage to an employee’s personal belongings (clothing, watch, glasses, contact lenses and prosthesis; jewellery is excluded with the exception of plain wedding bands) directly attributed to an assault while performing her work. It is understood that reimbursement shall be subsequent to completion of a Hospital Unusual Occurrence Report and the employee’s provision of a receipt. L.1 Violence in the Workplace (a) The parties agree While the Employer agrees that violence shall no form of verbal, physical, sexual, racial or other abuse of employees will be defined as any incident condoned in which the workplace, it is recognized that in some cases, nurses may be subject to inappropriate comments or conduct by patients, visitors, etc. who may be non-competent or upset, and further, that dealing with these situations can be an employee is abused, threatened or assaulted while performing his or her work. "Client Action" includes patients, clients, visitors and family members. (d) The Hospital will consider request for reimbursement for damages incurred to the nurse's personal property such as eyeglasses, ripped uniforms, personal clothing as a result of being assaulted while performing her work.
