Violence Sample Clauses
Violence. (a) The parties agree that violence shall be defined as any incident in which an employee is abused, threatened or assaulted while performing his or her work. The parties agree it includes the application of force, threats with or without weapons and severe verbal abuse. The parties agree that such incidents will not be condoned. Any employee who believes he/she has been subjected to such incident shall report this to a supervisor who will make every reasonable effort to rectify the situation. For purposes of sub- article (a) only, employees as referred to herein shall mean all employees of the Employer.
(b) The Employer agrees to develop formalized policies and procedures in consultation with the Joint Health and Safety Committee to deal with workplace violence. The policy will address the prevention of violence and the management of violent situations and support to employees who have faced workplace violence. These policies and procedures shall be communicated to all employees.
(c) The Employer will report all incidents of violence as defined herein to the Joint Health and Safety Committee for review.
(d) The Employer agrees to provide training and information on the prevention of violence to all employees who come into contact with potentially aggressive persons. This training will be done during a new employee’s orientation and updated as required.
(e) Subject to appropriate legislation, and with the employee’s consent, the Employer will inform the Union within three (3) days of any employee who has been subjected to violence while performing his/her work. Such information shall be submitted in writing to the Union as soon as practicable.
Violence. The hospital and the union agree that they have a shared goal of a workplace free of violence. To that end, the local parties will determine appropriate solutions to promote health and safety in workplaces, including, but not limited to: • Violence in the Workplace (including Verbal Abuse) • In particular, the local parties will consider appropriate measures to address violence in the workplace, which may include, among other remedies:
(i) Electronic and visual flagging;
(ii) Properly trained security who can de-escalate, immobilize and detain / restrain;
(iii) Appropriate personal alarms;
(iv) Organizational wide risk assessments assessing environment, risk from patient population, acuity, communication, and work flow and individual client assessments; and
(v) Training in de-escalation, “break-free” and safe immobilization / detainment / restraint.
Violence. A) acting aggressively by intimidating, threatening, or engaging in violent conduct through words or gestures, either individually or in a group setting (including while demonstrating, rallying or picketing);
B) behaving in a way, which, in the opinion of HS, may lead to violence or physical harm, directed towards any individual or group or create a situation that endangers the safety of others.

Subject to appropriate legislation, and with the employee’s consent, the Employer will inform the Union within three (3) days of any employee who has been subjected to violence while performing work. A worker shall, work in compliance with the provisions of the Occupational Health and Safety Act and the regulations; use or wear the equipment, protective devices or clothing that the worker’s employer requires to be used or worn; report to his or her employer or supervisor the absence of or defect in any equipment or protective device of which the worker is aware and which may endanger himself, herself or another worker; and report to his or her employer or supervisor any contravention of the Occupational Health and Safety Act or the regulations or the existence of any hazard of which he or she knows.
Violence. (a) The Hospital agrees that no form of verbal, physical, sexual, racial or other abuse of employee(s) will be condoned in the workplace. Any employee(s) who believes the situation to be abusive shall report this to the immediate Supervisor who will make every reasonable effort to rectify the abusive situation.
Violence. J.1 The Hospital and the Association agree that no form of verbal, physical, sexual or racial abuse of nurses will be condoned in the workplace.
J.2 The Hospital, with the nurse’s consent, where applicable, will inform the Association of any nurse who has been assaulted while performing her work. Such information shall be submitted in writing to the Association as soon as possible, in accordance with the Occupational Health and Safety Act.
J.3 If an act of violence against a nurse occurs in the Hospital and is reported, a copy of the Incident Report will be forwarded to the Joint Occupational Health and Safety Committee.
J.4 The Hospital and the Association recognize that where preventative measures have failed to prevent violent incidents, counselling and support will be available to help victims recover from such incidents.
J.5 The Hospital will consider requests for reimbursement for damages incurred to the nurse’s personal property such as eye glasses, ripped uniforms and personal clothing as a result of being assaulted while at work.

(a) The exercise of physical force by a person against a worker, in a workplace, that causes or could cause physical injury to the worker,
(b) An attempt to exercise physical force against the worker, in a workplace, that could cause physical injury to the worker, and
(c) A statement or behaviour that it is reasonable for a worker to interpret as a threat to exercise physical force against the worker, in a workplace, that could cause physical injury to the worker.

The parties agree it includes the application of force, threats with or without weapons and severe verbal abuse. The parties agree that such incident will not be condoned. Any Employee who believes he/she has been subjected to such incident shall report this to a supervisor who will make every reasonable effort to rectify the situation. This Article shall be subject to Section 43 of the Occupational Health and Safety Act which relates to certain circumstances or conditions being inherent in an Employee’s work.
(b) The Employer agrees to maintain formalized policies and procedures in accordance with applicable consultation with the Joint Health and Safety Committee to deal with workplace violence. The policy will address the prevention of violence and the management of violent situations and support to Employees who have faced workplace violence. These policies and procedures shall be communicated to all Employees.
(c) The Employer will report all incidents of violence as defined herein to the Joint Health and Safety Committee for review.
(d) The Employer agrees to provide training and information on the prevention of violence to all Employees who come into contact with potentially aggressive persons. This training will be done during a new Employee’s orientation and updated as required.
Violence. The hospital and the union agree that they have a shared goal of a workplace free of violence. “Workplace violence” means,
(a) The exercise of physical force by a person against a worker, in a workplace, that causes or could cause physical injury to the worker,
(b) An attempt to exercise physical force against a worker, in a workplace, that could cause physical injury to the worker, and
(c) A statement or behaviour that it is reasonable for a worker to interpret as a threat to exercise physical force against the worker, in a workplace, that could cause physical injury to the worker. The local parties will determine appropriate solutions to promote health and safety in workplaces, which shall include the adoption of the following mandatory provisions:
1. The Hospital will ensure that employees are properly advised in advance if they are required to interact with patients who the Hospital is aware have exhibited violent behaviour previously or who could otherwise reasonably be considered to pose a danger of exhibiting violent behaviour.
2. The Hospital shall give due consideration to whether, in light of all the relevant circumstances, it is appropriate that an employee interacts with a known violent patient alone.
3. The Hospital shall notify the Union without undue delay of any incident of an employee being subjected to violence at the workplace. The timing and nature of such notification may be negotiated locally by the parties. In addition, the local parties will consider addressing the inclusion of the following additional remedies:
(i) Electronic and visual flagging;
(ii) Properly trained security who can de-escalate, immobilize and detain / restrain;
(iii) Appropriate personal alarms;
(iv) Organizational wide risk assessments assessing environment, risk from patient population, acuity, communication, and work flow and individual client assessments; and
(v) Training in de-escalation, “break-free” and safe immobilization / detainment / restraint.
Violence. (a) The Hospital agrees that no form of verbal, physical, sexual, racial, or other abuse of nurses will be condoned in the workplace.
(b) The Hospital agrees to have in place policies and procedures to deal with violence in the workplace. The policies will address the process for dealing with violence and the prevention of violence in the workplace.
(c) Any nurse who encounters such acts of violence in the workplace shall report the incident to his/her immediate supervisor.
(d) The Hospital will ensure that there is a procedure in place to report all incidents of violence to the Joint Occupational Health and Safety Committee.
(e) The Hospital will inform the Bargaining Unit President within two (2) business days of any nurse who has been assaulted while performing his/her work.
(f) The Hospital will reimburse the nurse for damages incurred to the nurses’ personal property such as eyeglasses, ripped uniforms or personal clothing as a result of being assaulted while performing his/her work.
(g) The Hospital agrees to offer non-confrontational crisis intervention education.
(h) It is recognized that where preventative measures have failed to prevent violent incidents, counselling and support must be available to help victims recover from such incidents. (a) Employees working the ten (10) hour tour rotations are covered by the Collective Agreement except as amended in this Article.
(b) The procedures for the introduction or discontinuance of ten (10) hour tour rotations will be the same as for Extended Tour Rotations outlined in Article F-2, with the understanding that should the schedule have a monetary impact, Article F-4 (2) shall apply.
