Wage Underpayment and Overpayment. In the event an underpayment error is confirmed, the Employer will correct the error within five (5) Business Days of confirmed underpayment, or with mutual agreement with the employee at a later date, but in no event later than the employee’s next paycheck. In the event of an overpayment, the employee will work together with the District regarding the repayment. The employee will be provided written documentation of the overpayment and an explanation of how the overpayment occurred. Repayment will generally occur over the same period of time in which the overpayment of wages occurred but will not exceed what is allowable under State Law(s) specific to public employees. The Parties mutually agree it’s in the best interest of the Employer and Employees not to cause a financial hardship when repayment occurs. The Employees will access the Employer’s online systems to view and/or print their Leave and Earning Statements.

Wage Underpayment and Overpayment. In the underpayment of wages, the District will attempt to remedy the error as soon as possible, and in no event, later than the next payroll cycle. In the overpayment of wages to an Employee, the Employee will be required to pay back the amount of overpayment. A repayment plan may be established with the Employee for recovery of the funds over the period of time equal to the amount of overpayment or as otherwise mutually agreed. The Parties mutually agree it’s in the best interest of the Employer and Employee not to cause a financial hardship when repayment of an underpayment or overpayment occurs. The Employees will access the Employer’s online systems to view and/or print their Leave and Earning Statements.

  • Payment of Overpayment If at any time the Province provides Funds in excess of the amount to which the Recipient is entitled under the Agreement, the Province may:

In the event the employee does not receive the wages or benefits to which the record/documentation has for all times indicated the employer agreed the employee was entitled, the Agency shall notify the employee in writing of the underpayment. This notification will include information showing that an underpayment exists and the amount of wages and/or benefits to be repaid. The Agency shall correct any such underpayment made within a maximum period of two (2) years before the notification.

  • OVERPAYMENT OF PURCHASES OR UNDERPAYMENT OF FEES Without limiting any other remedy available to any Purchaser, Contractor shall (a) reimburse Purchasers for any overpayments inconsistent with the terms of this Master Contract or Purchase Orders placed thereunder, at a rate of 125% of any such overpayments, found as a result of the examination of Contractor’s records; and (b) reimburse Enterprise Services for any underpayment of vendor management fees, at a rate of 125% of such fees found as a result of the examination of Contractor’s records (e.g., if Contractor underpays the Vendor Management Fee by $500, Contractor would be required to pay to Enterprise Services $500 x 1.25 = $625); Provided, however, that, in the event Contractor timely discovers and corrects any Purchaser overpayment or Contractor underpayment of vendor management fees and does so prior to the initiation of any audit, Contractor shall be entitled to reimburse Purchaser or pay to Enterprise Services the actual amount of such Purchaser overpayment or such underpayment of vendor management fees.

  • Notice of Overpayment If the Contractor receives a vendor overpayment notice or a letter communicating the existence of an overpayment from DSHS, the Contractor may protest the overpayment determination by requesting an adjudicative proceeding. The Contractor’s request for an adjudicative proceeding must:

  • Repayment of Identified Overpayments Progenity shall repay within 60 days the Overpayment(s) identified by the IRO in the Claims Review Sample, in accordance with the requirements of 42 U.S.C. § 1320a-7k(d) and any applicable regulations or Centers for Medicare and Medicaid Services (CMS) guidance (the “CMS overpayment rule”). If Progenity determines that the CMS overpayment rule requires that an extrapolated Overpayment be repaid, Progenity shall repay that amount at the mean point estimate as calculated by the IRO. Progenity shall make available to OIG all documentation that reflects the refund of the Overpayment(s) to the payor. OIG, in its sole discretion, may refer the findings of the Claims Review Sample (and any related work papers) received from Progenity to the appropriate Medicare or state Medicaid program contractor for appropriate follow up by the payor.
