Waiver by Owner. (1) Owner may waive in whole or in part satisfaction by the Contractor of any of Contractor’s obligations, undertakings, covenants, representations or warranties made in favor of Owner. No waiver by Owner of any provision of this Contract, nor consent by Owner to any departure therefrom, shall in any event be effective unless and until it is signed by an officer of Owner, and then shall be effective only in the specific instance and for the purpose for which it is given. No failure or delay on the part of either party in exercising any right, power or privilege hereunder shall operate as a waiver thereof nor shall any single or partial exercise of any right, power or privilege hereunder preclude any other or further exercise thereof or exercise of any other right, power or privilege. (2) No (i) review and approval made or given by Owner hereunder;

Waiver by Owner. The waiver by Owner/Owner’s Broker of any breach shall not be construed to be a continuing waiver of any subsequent breach. The receipt by the Owner/Owner’s Broker of the rent with the knowledge of any violation of a covenant or condition hereto shall not be deemed a waiver of such breach. No waiver by Owner/Owner’s Broker of the provisions herein shall be deemed to have been made unless expressed in writing and signed by Owner or Owner’s Broker.
Waiver by Owner. Waiver if no insurance If the Owner doesn’t carry the property insurance described in Appendix F, then the Owner won’t make any claim against the Trust that would have been covered by the insurance described in Appendix F.

Waiver by Owner. The making of the Final Payment shall constitute a waiver of all claims by the Owner except: (a) those arising from unsettled liens, security interests or other encumbrances; (b) those arising from any warranties, guarantees and indemnities provided hereunder; and (c) those arising from Final Punch-List and clean-up items.

  • Waiver by Tenant Tenant expressly waives the benefits of any statute now or hereafter in effect which would otherwise afford the Tenant the right to make repairs at Landlord's expense or to terminate this Lease because of Landlord's failure to keep the Premises in good order, condition and repair.

Each Guarantor hereby waives any defense based on or arising out of any defense of the Borrower, any other Guarantor or any other Person other than indefeasible payment in full in cash of the Obligations, including any defense based on or arising out of the disability of the Borrower, any other Guarantor or any other Person, or the enforceability of the Obligations or any part thereof from any cause, or the cessation from any cause of the liability of the Borrower or any other Guarantor other than indefeasible payment in full in cash of the Obligations. Each Guaranteed Party may exercise any right or remedy it may have against the Borrower, any other Guarantor or any other Person, or any security, without affecting or impairing in any way the liability of any Guarantor hereunder (except to the extent the Obligations have been indefeasibly paid in full in cash. Each Guarantor waives all rights and defenses arising out of an election of remedies by a Guaranteed Party, even though that election of remedies, such as nonjudicial foreclosure with respect to security for a guaranteed obligation, has destroyed such Guarantor’s rights of subrogation and reimbursement against the Borrower.

  • No Waiver by Landlord No delay or forbearance by Landlord in exercising any right or remedy hereunder, or Landlord’s undertaking or performing any act or matter which is not expressly required to be undertaken by Landlord shall be construed, respectively, to be a waiver of Landlord’s rights or to represent any agreement by Landlord to undertake or perform such act or matter thereafter.   • Waiver The waiver by any party hereto of a breach of any provision of this Agreement shall not operate or be construed as a waiver of any other or subsequent breach.

Tenant shall attorn to any such transferee. After the date of any such transfer, the term "Landlord" as used herein shall mean the transferee of such interest in the Building or the Property.

  • No Waiver; Remedies No failure on the part of any Lender or the Agent to exercise, and no delay in exercising, any right hereunder or under any Note shall operate as a waiver thereof; nor shall any single or partial exercise of any such right preclude any other or further exercise thereof or the exercise of any other right.
