Common use of Waiver of Additional Bargaining Clause in Contracts

Waiver of Additional Bargaining. The parties acknowledge that during the negotiations that resulted in this Agreement, each had the right to make proposals with respect to any matter not removed by law or by specific agreement of the parties in the area of collective bargaining, and that the understandings and agreements arrived at by the parties after the exercise of that right are set forth in this Agreement. The parties, therefore, for the life of this Agreement, voluntarily and unqualifiedly waive any rights, which might otherwise exist under law, to negotiate over any matter during the term of this Agreement, except as otherwise specifically provided herein. The parties each further agree that they shall not be obligated to bargain collectively during the term of this agreement with respect to any subject or matter not specifically referred to or covered in this Agreement, even though such subject matter may not have been within the knowledge of either or both parties at the time they negotiated and signed this Agreement.

The parties, thereforeTherefore, for the life of this Agreement, the parties each voluntarily and unqualifiedly waive any rights, right which might otherwise exist under law, practice or custom to negotiate over any matter during the term of this Agreement, except as otherwise specifically provided herein. The parties Agreement and each further agree agrees that they the other shall not be obligated to bargain collectively during the term of this agreement with respect to any subject or matter not specifically referred to or covered in this Agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both of the parties at the time that they negotiated and or signed this Agreement.
