Waiver of Legal Rights. BY INITIALING IN THE SPACE BELOW, THE PARTIES ACKNOWLEDGE AND AGREE TO HAVE ANY DISPUTE ARISING OUT OF THE MATTERS INCLUDED IN THIS ARTICLE DECIDED BY NEUTRAL ARBITRATION AS PROVIDED UNDER ILLINOIS LAW AND THAT THEY ARE KNOWINGLY, INTENTIONALLY AND VOLUNTARILY WAIVING ANY RIGHTS THEY MAY POSSESS TO HAVE THE DISPUTE LITIGATED IN A COURT OR BY JURY TRIAL. THE PARTIES FURTHER ACKNOWLEDGE AND AGREE THAT THEY ARE WAIVING THEIR JUDICIAL RIGHTS TO DISCOVERY AND APPEAL EXCEPT TO THE EXTENT SUCH RIGHTS ARE SPECIFICALLY INCLUDED IN THIS SECTION. IF EITHER PARTY REFUSES TO SUBMIT TO ARBITRATION AFTER EXECUTION OF THIS AGREEMENT AND INITIALING BELOW, SUCH PARTY MAY BE COMPELLED TO ARBITRATE UNDER APPLICABLE ILLINOIS LAW. EACH PARTY’S AGREEMENT TO THIS SECTION IS VOLUNTARY. THE PARTIES HAVE READ AND UNDERSTAND THE FOREGOING AND AGREE TO SUBMIT DISPUTES ARISING OUT OF THE MATTERS INCLUDED IN THIS SECTION TO NEUTRAL ARBITRATION.
Waiver of Legal Rights. I understand and accept that alpine skiing and snowboarding in its various forms is a HAZARDOUS SPORT that has many dangers and risks. I realize that injuries are a common and ordinary occurrence of this sport and that severe injury, including death, is an inherent risk of skiing/snowboarding. I expressly assume all risk associated with skiing and/or snowboarding including without limitation, the risks and inherent dangers associated with skiing/snowboarding and riding the lifts. These risks include, but are not limited to, changes in terrain, weather and snow surfaces, changes in lighting conditions, ice, moguls, bare spots, debris, fences, posts, trees, lift equipment and towers, rope tows, light poles, signs, buildings, roads and walkways, ramps, half-pipes, padded and non-padded barriers, jumps, rails, boxes, and other terrain features, grooming equipment, snowmobiles, utility or all-terrain vehicles, loading, riding and unloading lifts, collisions with other persons and other natural and man-made hazards and slips and falls on ice and snow. I agree to follow, and be bound by, Your Responsibility Code.
Waiver of Legal Rights. I agree that this Assumption of Risk, Waiver, Release and Indemnification Agreement is to be construed under the laws of the State of Maryland (without regard to its conflicts of laws provisions); and that if any portion hereof is held invalid, the balance hereof shall, notwith- standing, continue in full legal force and effect. By signing this document I hereby acknowledge that I have read this entire document, that I under- stand its terms, that by signing it I individually and on behalf of all of the Releasors, including my minor child, am giving up substantial legal rights we might otherwise have, and that I have signed it knowingly, voluntarily and intending it to be legally binding.
Waiver of Legal Rights. Lessee waives the benefits of any law existing now or at any time during the term of this Lease and any extension thereof or thereafter giving Lessee rights or remedies as a result of the physical condition of the Premises, or Project and, without limitation, Sections 1932, 1933, 1941, 1941.2, 1942 and 1942.1 of the Civil Code of California and all right to make repairs at the expense of the City or to terminate this Lease as provided in those Civil Code sections or otherwise, except as expressly provided herein.

I intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. In executing this document, I intend for it to be binding on myself, my heirs, executors, administrators and representatives in the event of my death or incapacity.

I understand that I am waiving important legal rights by executing this Agreement and that if I institute any suit, action, claim, demand, or other proceedings as a result of any injury, damage, or loss arising out of or in connection with this Agreement and/or the Released Activities, this Agreement can and will be used against me and individuals or entities bound by this Agreement and that releases and waivers of this type have been upheld by Courts in similar circumstances.

In entering into this Termination Agreement, Distributor and Owner expressly waive any and all rights either of them have under any laws, rules, statutes or any common law principle of similar effect that provides that their respective waivers and releases do not extend to claims that Distributor and/or Owner do not know or suspect to exist in their favor at the time of execution and delivery of this Termination Agreement, which if known by Distributor and/or Owner would have materially affected its decision to execute and deliver this Termination Agreement. The consequences of the foregoing waiver have been explained by legal counsel to Distributor and Owner. Each of Distributor and Owner acknowledge that it may hereafter discover facts different from, or in addition to, those which it knows or believes to be true with respect to the claims released pursuant to this Termination Agreement, and Distributor and Owner agree that this Termination Agreement and the provisions contained herein shall be and remain effective in all respects notwithstanding such different or additional facts or the discovery thereof.
