Water and Sewer Capacity. The City agrees to sell or authorize the sale of water and sewer capacity to Owner, Developer, a Subsequent Developer, or Builders, as applicable, at the City rates in place as of the effective date of the Agreement of Consolidation and Transfer between Beaufort Jasper Water and Sewer Authority and the City of Hardeeville dated January 17, 2002, plus Two Hundred Fifty Dollar ($250.00) administration fee at the time of application for each building permit within the Property so long as such is available. Owner, Developer, or Subsequent Developer shall each have the right to assign any of its water and sewer capacity which it has acquired to third parties and collect administration fees in connection therewith in accordance with Section 5.6 of the Agreement of Consolidation and Transfer between Beaufort Jasper Water and Sewer Authority and the City of Hardeeville dated January 17, 2002. The $250.00 administrative fee shall be payable to the City at the time of application for a building permit.

Water and Sewer Capacity allocated to the Development is defined in Section (A)(1)(b) as the Development Allocation, and any changes to the Development scope requiring more than the allocated Development Allocation amount specified in Section (A)(1)(b) will require an amendment to this Contract. If not previously performed by its own engineer, Developer may be required to conduct its own capacity analysis using a licensed North Carolina Professional Engineer utilizing information provided by the Town due to limited Town resources. The Town will assist xxxxxx as possible to keep the process moving in a timely fashion. If results of the capacity analysis determine off-site improvements are needed to the Town’s existing system (conveyance or treatment) to accommodate the Development in excess of the Development Allocation (as defined in Section (A)(1)(b)), the Developer shall pay the cost of all such off -site improvements.

The Developer or Subsequent Developer shall each have the right to assign any of its water and sewer capacity which it has acquired to third parties and collect administration fees in connection therewith in accordance with Section 5.6 of the City/BJWSA Agreement. The administrative fee shall be payable to the City at the time BJWSA issues its capacity certificate acknowledging payment of the capacity fees.

  • Meter and Cabling Be obliged to draw electricity lines/wires, television cables, broadband data cables and telephone cables to the said Apartment only through the ducts and pipes provided therefor, ensuring that no inconvenience is caused to the Promoter or to other apartment owners.   • SLEEPING CAPACITY/DISTURBANCES Tenant and all other occupants of the premises will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the sleeping capacity of the property, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts that interfere with neighbors' right to quiet enjoyment of their premises. HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) loss, damage, illness, injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved include a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

  • Weighing and Scaling Costs Purchaser agrees to pay for all weighing costs for logs delivered regardless if logs are purchased on a weight or scale basis. In addition, Purchaser agrees to pay for all scaling costs for logs delivered on a scale basis. Purchaser also agrees to pay for all costs associated with the transmission and reporting of scale or weight data.

  • Acting Capacity ‌ When an employee is assigned temporarily to a job for which he/she is qualified in a higher pay grade for a period of five (5) days or his/her regular workweek, whichever is less, the employee shall be paid retroactively from the initial date of the temporary transfer for the duration of the temporary assignment. Any features that are not currently available but are technically feasible through the switch can be requested through the BFR/NBR process.
