Common use of Water Mains Clause in Contracts

Water Mains. The Developer shall construct the improvements necessary to the public water mains to serve the Project as described in Exhibit C-4. All existing public water lines are to be maintained and protected unless otherwise approved by the City Engineer. Any failure of the existing water lines as a result of the construction, or a failure to protect them during construction, shall be repaired immediately by Developer. Unless prearranged and agreed to by the City, failure of the Developer to repair the water lines to a functioning level within 12 hours shall result in the City being able, in its reasonable discretion, to make the necessary repairs and charge the Performance Bond for the reasonable costs. The Developer shall be responsible for construction of the necessary leads in accordance with City standards and shall obtain all necessary permits, as set forth in Exhibit F. The final alignment and connection points to the existing system shall be reasonably determined by the City Engineer during the detailed plan review process. Upon final approval of the newly constructed water lines, the Developer shall make the necessary connection to the existing water lines in accordance with City standards. Unless prearranged and agreed to by the City, at no time shall service be disrupted for more than 12 hours. Failure of the Developer to timely connect the water lines to a functioning level within 12 hours or as otherwise agreed shall result in the City being able, in its reasonable discretion, to make the necessary connection/repair and charge the Performance Bond for the reasonable costs incurred by City as a result of the failure to timely connect.
