Weight Determination. (a) The procedures for establishing the weight of any Wet Sand delivered to the Production Delivery Point shall be as specified in Schedule 8.
(b) The procedures for establishing the weight of any Wet Sand delivered to the Tender Delivery Point shall be as specified in Schedule 8, but modified as the context requires and with the exception that the “Primary Wet Sand Scales” will be those scales operated by SSS near the Tender Delivery Point.
Weight Determination. All Pine and Hardwood Roundwood delivered hereunder shall be weighed by Domtar. Weighing and basis for payment for truck delivered Pine and Hardwood Roundwood shall be by ton weight. A ton is 2,000 pounds. Subject to Section 3.3, Weyerhaeuser agrees to be bound by Domtar’s weigh scale.
Weight Determination. (a) The procedures for establishing the weight of any Dry Sand delivered to the Dry Sand Silos shall be as specified in Schedule 6.
(b) The procedures for establishing the weight of any Wet Sand delivered by SSS to the Wet Sand Stock Pile Area shall be as specified in Schedule 6, but modified as the context requires and with the exception that the “Primary Dry Sand Scales” will be those scales operated by SSS on the Site.
(c) The procedures for establishing the weight of any Wet Sand processed by SSS and converted to Dry Sand shall be as specified in Schedule 6, but modified as the context requires and with the exception that the “Primary Dry Sand Scales” will be those scales operated by SSS and installed as a belt scale at the start of the Dry Plant where the Wet Sand enters for purposes of producing Dry Sand.
(d) The procedures for establishing the weight of any Dry Sand delivered by SSS to the Tender Delivery Point shall be as specified in Schedule 6, but modified as the context requires and with the exception that the “Primary Dry Sand Scales” will be those scales operated by SSS on the Site.
Weight Determination. All wood chips delivered hereunder shall be weighed by Weyerhaeuser. Weighing and basis for payment for truck delivered chips shall be by ton weight. A ton is 2,000 pounds. Weyerhaeuser will furnish individual weight tickets on each load delivered. Subject to Section 3.2, Weyerhaeuser agrees to regular and routine audits of load weights to verify accuracy of weights. The audit loads will be weighed on Domtar’s certified scales. Both parties will accept any weight differences greater than 100 pounds discovered by the audit and the difference will be applied to all loads received since the prior audit.
Weight Determination i. The certified rail weight utilized at the time the coal is loaded at the Loadout into the Cars shall be the binding weight for determining payment, if any, for the use of the Cars.
Weight Determination. Weight shall be determined by Seller’s weighbridge.
Weight Determination. The weight of the Coal cargo loaded onboard the vessel shall be determined at the loading port using draft surveys. The draft surveys shall be conducted by Independent Inspection agency. The Independent Inspection agency (IIA) shall provide the corresponding Certificate of Weight for the shipment at loading port. The weight so determined shall be final and binding upon Seller and Buyer for the purpose of this Agreement, and shall form the basis of settlement. The costs of weighing (including, without limitation, the costs of the marine surveyor) shall be for the Seller's account.
Weight Determination. All wood hog fuel delivered hereunder shall be weighed by Weyerhaeuser. Weighing and basis for payment for truck delivered hog fuel shall be by ton weight. A ton is 2,000 pounds. Weyerhaeuser will furnish individual weight tickets on each load delivered. Subject to Section 3.2, Weyerhaeuser agrees to regular and routine audits of load weights to verify accuracy of weights. The audit loads will be weighed on Domtar’s certified scales. Both parties will accept any weight differences greater than 100 pounds discovered by the audit and the difference will be applied to all loads received since the prior audit.
Weight Determination. To calculate the weight to be used for purposes of the rates set forth on Exhibits A and D for the Outside Receiving Stations, 97% of the raw weight (2000 pounds per ton) of sugarbeets delivered by growers at that station, less the agreed upon raw weight of sugarbeets discarded by ACSC, shall be used. To calculate the weight for purposes of the rates set forth on Exhibits A and D for the Factory Receiving Stations, 91.6% of the raw weight (2,000 pounds per ton) of sugarbeets delivered by growers to such piles, less the agreed upon raw weight of sugarbeets discarded by ACSC shall be used. Raw weight shall mean the weight of purchased sugarbeets before the deduction for tare. The record of weights of sugarbeets hauled under this Agreement will be kept by ACSC and statements of weights shall be furnished by ACSC to Contractor.
Weight Determination. (a) The Independent Testing Agency will determine the weight of each delivery of Product at the Port of Loading. The Independent Testing Agency will issue a weight certificate (“Certificate of Weight”) for delivered Product on a wet basis (i.e. without deducting free moisture) and on a dry basis by deducting free moisture loss at the appropriate temperature having analysed the moisture content in the relevant sample.
(b) The Parties may, at its own expense, have their representatives present at the time of such determination. The Seller must ensure that the Buyer’s representatives receive reasonable advance notice of any weight determination.
(c) The Certificate of Weight issued under Clause 1(a) of this Schedule is final and binding for determining the DMT of that Shipment of Product.
