Common use of Withdrawal or Abandonment of Grievances Clause in Contracts

Withdrawal or Abandonment of Grievances. (a) An employee may withdraw a grievance at any time by so stating in writing to the designated representative at the level at which the grievance exists. (b) If an employee does not submit a grievance within the time limits stipulated in Step 1 and Step 2 of the grievance procedure, then the grievance shall be deemed to be abandoned and all rights of recourse to the grievance procedure for that particular grievance shall be at an end. However, if either party fails to process a grievance from Step 2 to Step 3 within the time limits specified, it shall not be deemed to have prejudiced its position in arbitration.
