WOOD INFESTATION REPORT. At the time of Closing, Seller shall provide Purchaser with a letter or a soil treatment report from a pest-control company licensed in North Carolina certifying that the home has been treated within one (1) year of the date of Closing for subterranean termite infestation. If required by Purchaser’s lender, Purchaser may obtain at Purchaser’s expense a North Carolina Wood Infestation Report performed by a pest-inspection company licensed in North Carolina.

WOOD INFESTATION REPORT. No later than ten (10) days prior to Closing, the Buyer, at Buyer’s option and expense (if a VA Mortgage Loan and required by the VA, at Seller’s expense) may obtain a wood infestation and/or termite report from a licensed inspection service (“Insect Report”) chosen by the Buyer. Should the Insect Report disclose either active infestation or substantial (not merely cosmetic) damage as a result of such existing or former infestation by termites or other wood- destroying insects about which there is no evidence of prior professional treatment, the Buyer may serve an Inspection Response on the Seller within two (2) days after Xxxxx has received said Insect Report requesting the Seller to remediate the concern raised in the Insect Report. The Seller shall, within five (5) days after receipt of same (“Seller’s Deadline”), notify the Buyer of Seller’s plan to correct such infestation and/or damage or other options as stated in the Inspection Response. If Seller fails to respond, or Xxxxx rejects Xxxxxx’s plan, the Buyer may terminate the Contract by delivery to Seller of a
WOOD INFESTATION REPORT. Seller agrees to provide at its expense an "Official South Xxxxxxxx Xxxx Infestation Report (CL-100)" in which no infestation or damage is reported, or if there is damage observed, it is cosmetic only and insufficient to recommend repair. Such report must be dated within 30 days of the Closing and shall be provided to Purchaser's closing attorney not less than 14 days prior to Closing. If infestation by termites or other wood destroying organisms, or damage sufficient to recommend repair in the opinion of a licensed contractor, is observed, Seller shall cause same to be eradicated and/or repaired prior to Closing. If repairs are not completed by the Closing, then Purchaser shall have the option of (a) delaying Closing until the repairs are completed, or (b) if permitted by Purchaser’s lender, Seller shall permit Purchaser's closing attorney to escrow funds from the sales proceeds at Closing in an amount equal to the costs of such repair. If the Property has not been previously occupied, Seller shall provide the Purchaser by Closing a written certification from a licensed pest control operator certifying that the dwelling has been treated by soil poisoning for the prevention of termites and other wood destroying organisms.

WOOD INFESTATION REPORT. At time of closing, Seller shall provide Purchaser with a wood infestation report, in the current form officially approved by the Georgia Structural Pest Control Commission, from a properly licensed pest control company stating that the main dwelling has been inspected and found to be free from visible infestation and structural damages caused by termites and other wood destroying organisms or that if such infestation or structural damage or both existed it has been corrected. The inspection referred to in such report shall have been made within thirty (30) days prior to closing.

WOOD INFESTATION REPORT. At least five (5) but no more than thirty (30) calendar days prior to Closing, Purchaser shall, at Purchaser's expense, obtain a written report from a pest control firm certifying to Purchaser (with a copy provided to Seller prior to closing) that the Premises have been inspected within such period for termite and other wood-destroying insect infestation. For purposes hereof, Premises shall include all improvements on the Premises. If active infestation is found anywhere on the Premises, all portions of the Premises recommended by the inspection firm shall be treated by a reputable company of Seller's choice at Seller's expense. Any other or further treatment, except as set forth by the foregoing, shall be at the expense of Purchaser. If structural damage due to prior or existing infestation is found, Seller shall have the option of correcting the structural damage or returning the Xxxxxxx Money to Purchaser and terminating this Agreement and the parties hereto shall have no further obligations hereunder unless Purchaser chooses to waive such repairs and accept the Premises in its existing condition. Seller shall not be responsible for termite or other wood boring insect infestation or damage beyond Closing. Purchaser must give written notice to Seller of infestation and damage no later than Closing. Failure to give written notice no later than the Closing Date shall constitute a waiver of any claim against Seller under this paragraph.

WOOD INFESTATION REPORT. Seller agrees to furnish a written Alabama Wood Infestation Report issued by a bonded and licensed pest control company stating that the visible and accessible areas of the dwelling, carport and garage and any detached buildings given value by an appraisal are free from active infestation by Formosan and subterranean termites, powder post beetles, wood boring beetles, dry wood termites and wood decaying fungi. If active infestation or fungus is reported, treatment of the entire dwelling will be required unless Property is under a current termite contract in which case a re-treatment of the affected area will be permitted. Treatment will also be required in affected outbuildings if required by lender. Old damage will not be considered if no live infestation is found. The current termite contract, if any, shall be kept current and transferred to Buyer, if transferable, at Xxxxx's expense at Closing. Seller is X is not aware of any previous infestation or damage by wood destroying organisms.
