WOOD INFESTATION REPORT. At the time of Closing, Seller shall provide Purchaser with a letter or a soil treatment report from a pest-control company licensed in North Carolina certifying that the home has been treated within one (1) year of the date of Closing for subterranean termite infestation. If required by Purchaser’s lender, Purchaser may obtain at Purchaser’s expense a North Carolina Wood Infestation Report performed by a pest-inspection company licensed in North Carolina.
WOOD INFESTATION REPORT. No later than ten (10) days prior to Closing, the Buyer, at Buyer’s option and expense (if a VA Mortgage Loan and required by the VA, at Seller’s expense) may obtain a wood infestation and/or termite report from a licensed inspection service (“Insect Report”) chosen by the Buyer. Should the Insect Report disclose either active infestation or substantial (not merely cosmetic) damage as a result of such existing or former infestation by termites or other wood- destroying insects about which there is no evidence of prior professional treatment, the Buyer may serve an Inspection Response on the Seller within two (2) days after Xxxxx has received said Insect Report requesting the Seller to remediate the concern raised in the Insect Report. The Seller shall, within five (5) days after receipt of same (“Seller’s Deadline”), notify the Buyer of Seller’s plan to correct such infestation and/or damage or other options as stated in the Inspection Response. If Seller fails to respond, or Xxxxx rejects Xxxxxx’s plan, the Buyer may terminate the Contract by delivery to Seller of a

Seller agrees to provide at its expense an "Official South Xxxxxxxx Xxxx Infestation Report (CL-100)" in which no infestation or damage is reported, or if there is damage observed, it is cosmetic only and insufficient to recommend repair. Such report must be dated within 30 days of the Closing and shall be provided to Purchaser's closing attorney not less than 14 days prior to Closing. If infestation by termites or other wood destroying organisms, or damage sufficient to recommend repair in the opinion of a licensed contractor, is observed, Seller shall cause same to be eradicated and/or repaired prior to Closing. If repairs are not completed by the Closing, then Purchaser shall have the option of (a) delaying Closing until the repairs are completed, or (b) if permitted by Purchaser’s lender, Seller shall permit Purchaser's closing attorney to escrow funds from the sales proceeds at Closing in an amount equal to the costs of such repair. If the Property has not been previously occupied, Seller shall provide the Purchaser by Closing a written certification from a licensed pest control operator certifying that the dwelling has been treated by soil poisoning for the prevention of termites and other wood destroying organisms.

The inspection referred to in such report shall have been made within thirty (30) days prior to closing.

If the Property to be sold has been previously occupied, this Contract is ◻contingent ◻not contingent upon the ◻Buyer ◻Seller having the Property inspected at their expense by a qualified/licensed/bonded pest control operator selected by the ◻Buyer ◻Seller. ◻Buyer ◻Seller shall deliver timely Notice of and shall deliver to Closing a CL100 Wood Infestation Report dated no earlier than 30 calendar days prior to Closing and no later than calendar days prior to Closing. If the Buyer is responsible for having the Property inspected as indicated above, but does not have the Property timely inspected for the report's required Delivery time frame, the Buyer waives any and all rights under the terms of this section. The Seller makes no warranties with regard to matters covered by such infestation report or any other improvement unless specifically stated in this Contract. If the wood infestation report reveals the presence or indication of or damages by termite infestation or other wood destroying organisms, Seller shall remedy such deficiencies and shall furnish the Buyer with a CL100 wood infestation report by a qualified/licensed/bonded pest control operator (dated no earlier than 30 calendar days prior to Closing) that the Property is free from infestation or any damage herein mentioned; or documentation that the infestation has been treated and damage has been repaired as appropriate in a workmanlike manner on or before closing and reported by an appropriate licensee. State law and regulations control CL100 issues. If the Seller does not make the repairs and treatment, the Buyer shall have the option to (1) accept the Property in its present condition, (2) negotiate with the Seller for the payment of these repairs and treatment, or (3) terminate this Contract by Delivering Notice of Termination to the Seller. If the Property to be sold has not been previously occupied, Seller shall certify that the Dwelling has been treated by soil poisoning for the prevention of termites and other wood destroying organisms and shall provide at Closing to the Buyer a written certification from a qualified/licensed/bonded pest control operator. The obligations of the Seller under this Section terminate after the Closing.

SURVEY AND FLOOD CERTIFICATIONS: Survey and flood certifications are the best way to identify boundary lines / encroachments / easements / or property in a flood zone area. It is the buyers responsibility to choose if they want or do not want a survey. Xxxxx agrees to hold broker and agents harmless if they choose not to get a survey and a discrepancy arises after closing of the transaction.
