Common use of Work Out of Class Clause in Contracts

Work Out of Class. When a supervisor is expressly assigned to perform substantially all of the duties of a position allocated to a different class that is temporarily unoccupied and the work out of class assignment exceeds ten (10) consecutive work days in duration, the supervisor shall be paid for all such hours at the supervisor's current salary when assigned to work in a lower or equal class or at a rate within a higher range which is equal to the minimum rate for the higher class or at least one (1) step higher than the supervisor's current salary, whichever is greater. When a supervisor is assigned to serve in a class for which he/she is on a layoff list, the supervisor shall be paid as provided above or the maximum step previously achieved by the supervisor, whichever is greater.

When a supervisor is expressly assigned to perform 16 substantially all of the duties of a position allocated to a different class that is temporarily 17 unoccupied and the work out of class assignment exceeds ten (10) consecutive work days in 18 duration, the supervisor shall be paid for all such hours at the supervisor's current salary when 19 assigned to work in a lower or equal class or at a rate within a higher range which is equal to 20 the minimum rate for the higher class or at least one (1) step higher than the supervisor's 21 current salary, whichever is greater. When a supervisor is assigned to serve in a class for which he/she is 1 they are on a layoff list, the supervisor shall be paid as provided above or the maximum step 2 previously achieved by the supervisor, whichever is greater.
