Working Out of Classification. Whenever an employee is assigned the principal duties and responsibilities of an employee in a higher classification for a single shift or greater period of time, that employee shall be paid a minimum of three (3) steps above their present salary, or shall receive the salary at the bottom of the range for the classification which they are working in, whichever is greater, for all such time worked.
Working Out of Classification. 13.1 Employees assigned by the Employer to assume the full responsibilities and authority of a higher job classification shall receive the salary schedule of the higher classification for the duration of the assignment.
Working Out of Classification. 8.1 Employer shall avoid, whenever possible, working an employee on an out-of-class assignment for a prolonged period of time. Any employee working an out-of-class assignment for a period in excess of fifteen (15) consecutive working days shall receive the rate of pay for the out-of-class assignment in a higher classification not later than the sixteenth (16th) day of such assignment. For purposes of this Article, an out-of-class assignment is defined as an assignment of an employee to perform, on a full-time basis, all of the significant duties and responsibilities of a position different from the employee’s regular position, and which is in a classification higher than the classification held by such employee. The rate of pay for an approved out-of-class assignment shall be the same rate the employee would receive if such employee received a regular appointment to the higher classification.
9.1 The wage schedule for the purpose of this contract shall be Appendices A and C.
Working Out of Classification. A) In the instance where a bargaining unit member is temporarily assigned to a higher classification, they will receive a pay rate adjustment if they work in the higher classification for a continuous period of two (2) weeks or more. The pay adjustment will increase the employee’s hourly rate of pay by ten percent (10%) or to the starting rate of pay for the higher classification, whichever is greater. The parties agree employees shall normally not be “temporarily assigned” for more than one hundred twenty (120) days in any twelve (12) month period, unless the parties mutually agree to a longer assignment. However, in a situation where a bargaining unit member is “temporarily assigned” to a higher classification due to illness, injury or some other approved leave of absence of another bargaining unit employee, the temporary assignment will last for the duration of the approved leave of absence.
B) It is understood by the parties that if an assignment involves the bargaining unit member being assigned job duties that have a lower pay rate than their regular job classification, the bargaining unit member will be paid wages they earn in their regular job classification.
C) In the instance where the bargaining unit member is assigned job duties, in accordance with Section 20.8 (A), on a continuous or permanent basis, and these job duties are of a higher classification, the University and the Union may mutually agree to permanently reclassify the bargaining unit member to the higher classification. Pay rates for reclassifications are addressed in Article 3.3 (A).
D) When a bargaining unit member is assigned a higher classification, in accordance with 20.8 (A) or 20.8 (B), the University shall provide the directive/assignment to the bargaining unit member in writing before the work commences.
E) Allegations of procedural impropriety should be immediately reported to Human Resources.
Working Out of Classification. Bargaining unit employees are considered to be working ‘out-of-class’ when they are assigned by the University to perform the duties of a job specification that pays a higher job rate than the employee’s current job. A bargaining unit employee that is deemed by the University to be working ‘out-of-class’ in a bargaining unit position shall be paid the job rate of the higher classification assigned. If the University, in its sole discretion, assigns a bargaining unit employee to work in a supervisory position, the most qualified employee in the work unit will be assigned the work. The employee will be paid an additional ten percent (10.0%) for those hours performing work in the supervisory position. If a bargaining unit member is assigned supervisory work or is assigned work in a job specification that pays a higher job rate than the member’s current job, the employee will receive out-of-class pay for all time worked in that higher capacity. However, the parties understand that there are no requirements that the University assign a bargaining unit member to work out-of-class unless it determines, in its sole discretion, that it will assign that work. A bargaining unit employee is not considered to be working ‘out-of-class’ if he/she meets any one of the criteria below: • The ‘out-of-class’ duties were not assigned by the University and the employee voluntarily requested the work or assumed the duties. • The employee is performing the prescribed duties while on a training assignment, in an apprenticeship or other training classification, or is performing duties different from regular duties due to an injury, an illness, or participation in transitional duty. If an employee is temporarily assigned to a lower job classification, the employee shall continue to receive the employee's regular rate of pay during such assignment, except that this provision does not cover an employee who is demoted by the University.
Working Out of Classification. Employees in full-time non-seasonal job classifications as listed in Appendix B who are temporarily assigned by a designated management representative the duties of a classification assigned a higher wage rate, will be paid four percent (4%) above the employee's current rate for each hour worked in the higher class upon completing at least four (4) hours of a workday in the higher class. Working out of class assignments are not to be used in lieu of seeking approval for filling a vacant position, nor shall it be used for the sole purpose of paying an employee at a higher class in circumvention of the requirements set forth by the Civil Service Commission.
Working Out of Classification. When an employee is assigned to perform some of the duties of a position intermittently at a higher level classification that are not in their current classification, the employee shall be paid five percent (5%) differential for all hours worked in a higher classification.
Working Out of Classification. SECTION 1. Each time an employee is officially designated by the appropriate supervisor to act in a higher classification, and actually performs said duties for one (1) complete duty shift and meets the minimum qualifications of said position, the employee shall be compensated for all hours worked in the higher salary grade, unless the rate is lower than the employee's regular rate, in which case the employee shall remain at his/her present rate of pay. It shall be the responsibility of the supervisor to identify those hours worked out of class for pay purposes.
SECTION 2. No employee shall be required to work out of his/her class if such employee does not have the prerequisite qualifications to perform such work, nor shall any employee be required to work out of class for the purpose of avoiding paying someone else a higher salary grade.
SECTION 3. Employees being paid at a higher rate while temporarily filling a position in a higher classification will be returned to their regular rate of pay when the period of temporary employment in the higher class ends.
SECTION 4. Employees working out of classification shall be entitled to all benefits provided by this Agreement to the position to which they are assigned.
SECTION 5. An employee who is assigned to work out of classification shall receive a minimum of five percent (5%) increase in compensation, in accordance with the appropriate pay range of the absent employee. At no time shall an employee receive any compensation beyond the top step of the higher pay scale.
Working Out of Classification. Any employee who is assigned by appropriate authority to perform all of the duties of a higher paying classification and/or assignment for a continuous period of one (1) day or any portion thereof or longer shall be paid at the first pay step of the higher position for each day worked at the higher classification and/or assignment.
Working Out of Classification. Any Assistant Chief who is required to accept the responsibilities and carry out the duties of the Fire Chief shall be paid at the rate of pay of the Fire Chief or 16% above the member’s current rate of pay, whichever is less.
