Working Conditions of Teachers. Committee shall not later than five (5) working days after May 25 submit to the FederationDistrict Committee a memorandum that describes areas of consensus and defines issues on which they continue to differ.
(c) Notification The Principal may implement a design that includes the areas of appointment to summer school shall be made by June 1 for at least ninety percent (90%) consensus with the Building Committee unless the FederationDistrict Committee con cludes that the design does not reasonably satisfy the abovestated criteria, in which case the School District members of the number of teachers estimated Committee shall work with the Principal to be needed for the programdesign an appropriate Master Schedule/Roster.
(d) Teachers will Notification of their proposed grade or class assignment for the following school year shall be provided given to each teacher at as early a choice of schools and, where administratively possible, that choice will be honored in making assignmentsdate as possible after allotments are complete.
(e) Seniority in summer In middle and senior high schools by June 15 or the last day of school, whichever is earlier, tentative rosters shall be distributed to the individual teach ers. If changes are made between tentative rosters and final rosters, any teachers concerned shall be notified. In addition to the Building Committee, any interested teacher from that particular school shall govern when it becomes necessary to reduce positions. Where such summer school seniority is equal, then systemwide seniority shall applymay examine the organization plan.
(f) Information regarding In elementary schools by June 15 or the number last day of allotted positions by level and sub jects as well as school, whichever is earlier, teachers appointed to such positions shall be made available to the Federation on a timely basisnotified of what grades and sections they will teach and every teacher will receive their tentative new class name list, including each pupil’s reading level.
(g) Additional appointments During the summer when the roster is actually being constructed, any teacher, as well as members of the Building Committee, may come to summer the school to review and discuss the roster with the administrator in charge as it is being constructed.
(h) The master roster shall be made as needed dur ing posted in each school.
(i) A teacher xxx, with their consent, be assigned to more than five (5) periods of teaching a week outside of their field of appointment.
(j) In departmentalized schools, rostering practices shall include a limitation on the summer school sessions in accordance number of grade levels or subjects and the number of tracks within grade level or subject to be taught. The number of grade levels or subjects to be taught shall be limited to three (3). The number of different lessons to be prepared according to grade level and type of class within the grade level shall be limited to four (4), except where the number of specialized subject area teachers assigned to a department makes such limitations impossible.
(k) To the extent administratively possible, a teacher with subsection (b) of this Article. If a list is exhausted, then teachers certified in that subject and on another current summer school list (though not appointed from it) appropriate quali fications shall be given the opportunity to fill teach classes of varying grade and achievement levels. In addition, special consideration shall be given to rosters assigned to new teachers so that new teachers are not assigned to teach the position as a temporary appointee. If most challenging classes or the name of such temporary appointee is reached on the eligibility list for a regular appointment, they shall continue in the temporary position for the duration of the summer session. However, their seniority for summer school purposes, in the subject of the eligi bility list shall begin from the date their name was reached on such eligibility listmost difficult students.

Working Conditions of Teachers. return to parttime positions, as well as full time positions in their “right to return” school up to one (c1) Notification of appointment day before the first teacher day in the same school year or during the spring assignment and transfer process in the following year if the teacher’s position is restored. The School District shall notify those on file who have filed such a “right to summer school shall return” provided, however, that such individuals may be made by June 1 for at least ninety percent assigned to one (90%1) or more schools to keep that employee in full time status. An employee who has been forced transferred may file a righttoreturn to their former work location within one (1) year of the number effective date of teachers estimated their new assign ment. (1) A teacher in an elementary school support position who wants to return to a grade assignment, and sub jects as well as teachers appointed to such positions is so qualified, shall be made available indicate this desire in writing to the Federation on Principal by March 15 for the following term. If there is a timely basisvacancy, and subject to the agreement of the Principal and teacher, reorganization for the following term will include said teacher as a classroom teacher.
(2) If no vacancy exists, the Principal may assign any of the three (3) least senior grade teachers to the specialist position.
(g) Additional appointments Teachers appointed to summer school Early Childhood Programs shall be made as needed dur ing eligible to apply for transfer to vacant positions in the summer public school sessions in accordance with subsection program subject to transfer provisions and certification requirements. The same applies to public school teachers who wish to transfer to any of the Early Childhood Programs.
(bh) Transfers shall be permitted between elementary, middle and senior high schools. Transfers shall be based on the provisions of this Article.
(i) Assignments and transfers of teachers will occur in the following order:
(1) The Office of Talent honors right to return, rights to follow and reten tion requests.
(2) The spring site selection process shall occur for employees and new hires, with Early Access Site Selection opening first and then Site Selection shall open for remaining vacancies. Early Access Site Selection may begin on or after January 2, for vacancies in schools, not to exceed twentyfive schools, as designated by the District. If a list school is exhausteddesignated as eligible for Early Access Site Selection during the term of this Agreement, then teachers certified in that subject and on another current summer the school list (though not appointed from it) shall be given the opportunity to fill the position as a temporary appointee. If the name of such temporary appointee is reached on the eligibility list for a regular appointment, they shall continue in the temporary position remain eligible for the duration of the summer sessionterm of this Agreement. However, Early Access Site Selection is intended to provide schools with additional time to attract teachers to their seniority for summer school purposes, com munities and to give applicants premier access to designated schools. The District shall notify the Federation in the subject advance of the eligi bility list dates when Early Access Site Selec tion shall begin from open for the date their name was reached on such eligibility listdesignated schools. The spring site selection process shall end no later than July 1.
(h3) A summer Within one (1) week of a school notifying the Office of Talent that it has selected a teacher may take to fill a site selected vacancy, the Office of Talent shall send an unpaid leave of absence for up electronic notice to two (2) xxxxxxx if they are on sabbatical leave from regular school. A teacher taking such leave of absence shall retain their position and continue to accrue seniority and all other benefits as though they were teachingthe teacher.
(i4) A summer school teacher shall be permittedAt the end of the site selection process, during the summer session, to use sick leave accumulated during the regular school year.all unfilled vacancies are identified and listed with all other vacancies;

23. Psychologists shall not be required to report on days when all schools are closed by administrative action.
24. To the extent permitted by budgetary allocation and the availability of personnel, and regardless of class size, a kindergarten class shall be provided with a kindergarten assistant or supportive services assistant who shall be assigned to provide the teacher with the same relief provisions as are provided other elementary school teachers.
25. The library shall be available for library purposes to students and teach ers at all times during the school day, except that Administration may schedule meetings on occasions that would not unreasonably interfere with the use accumulated personal leave from regular of the library.
26. To insure minimum standards of privacy and confidentiality (a) provision shall be made in new school buildings for each counselor to have their own office with floor to ceiling soundconditioned partitions; the same provision shall be made in old schools, the floor to ceiling partitions dependent upon the reasonable availability of existing natural or mechanical ventilation and (b) in any event, a counselor’s office shall contain a door that can be closed, a tele phone for the same reasons use of the counselor and file cabinets that lock.
27. The caseload for occupational and physical therapists shall be equivalent to the caseload established by the Commonwealth of Pennsylvania for speech therapists as they may be amended from time to time, until such leave is used time as the District implements a workload staffing model. During the 202223 school year, the District shall implement a workload staffing model for occupational thera pists, physical therapists, and speech therapists. Within sixty (60) days of ratification, a committee shall be established comprised of three (3) representatives designated respectively by the Superin tendent and the Federation. The committee shall discuss the development of a workload staffing model for occupational, physical and speech therapists. In the event the committee cannot reach consensus, then the matter shall be referred to the FederationDistrict Committee. The Committee shall meet as needed during the regular 202122 school yearyear to discuss the occupational, physical and speech therapists staffing models. The Committee shall also be reconvened to discuss any modifications to the staffing models prior to implementation.

10. Assignment of Vocational Coordinators and Court Representatives
(a) Coordinator positions allotted to Vocational/Technical Schools may be reduced subject to the following procedure:
(b) As vacancies occur anywhere in the School District of Philadelphia for Department Head positions in Math, Social Studies, English or Science, a Prin- cipal of a Vocational/Technical School may reduce the Coordinator allotment at the school for that Coordinator subject area. The affected Coordinator shall be a force transfer.
(c) If a Coordinator position becomes vacant for any reason at a Vocational/ Technical School, the Principal may abolish the vacant position.
(d) If a court representative, employed in that position as of September 1, 2000, vacates that position for any reason he/she need not be replaced.

(kv) A summer school teacher Any contract waiver achieved shall be permitted presumed to continue in effect for a complete school year. Thereafter the waiver shall continue to be effective unless modified through the procedures of this Section.
(8) When a school organization has the option to implement school-based selection of teachers, a decision to use accumulated personal leave school-based selection shall be made by December 31st prior to the hiring season that such school-based selection pro- cedures are implemented.
(m) All vacancies in High Needs Schools shall be filled through site selection. If a school is removed from regular the High Needs Schools list, vacancies shall be filled in accordance with the general procedures for filling vacancies. If a school is added to the High Needs Schools list, vacancies shall be filled through site selection.
8. Training, Implementation and Evaluation
(a) In accordance with Article X, intensive professional development shall be provided to the members and potential members of the Staff Selection Commit- tee in each school that is scheduled to implement school-based selection of teachers to prepare them to participate in the staffing process for their school.
(b) The administration shall, upon request, provide the same reasons as such leave is used during Federation with the regular school yearnumber of authorized vacancies and the number of teachers by racial designation for each school.

Each psychologist shall be made by June 1 for at least ninety percent (90%) provided with reasonable facilities and required equipment that will permit uninterrupted service with the child being examined. Because of the number limitation of teachers estimated to be needed for available space, psychologists will give the programschool three (3) days’ notice of appointments with children.

19. Information pertaining to professional opportunities applicable to school psychologists shall be distributed to and posted in all Regions and Central Offices in which school psychologists are located so that all psychologists have the opportunity to fill the position as a temporary appointee. If the name of such temporary appointee is reached on the eligibility list for a regular appointment, determine whether they shall continue in the temporary position for the duration of the summer session. However, their seniority for summer school purposes, in the subject of the eligi bility list shall begin from the date their name was reached on such eligibility listwish to participate therein.
(h) A summer school teacher may take an unpaid leave 20. The assignment of absence for up a psychologist to two (2) xxxxxxx if they are a special project requiring special qualifications and competencies shall be offered to those psychologists possess- ing such special qualifications and competencies on sabbatical leave a rotation basis, beginning with the most senior psychologist. In the event no such psychologist indicates his/her willingness to perform such assignment the psychologist with such spe- cial qualifications and competencies with the least seniority shall be assigned to such special projects on a rotation basis beginning with the least senior such psychologist.

Working Conditions of Teachers. (c) Notification giving serious consideration to the removal of appointment such pupils from the class, not for the purpose of punishing the pupils involved but rather to summer school find the causes of such behavior and to attain remedies therefor.
12. Mentally, emotionally and educationally handicapped children shall at the earliest possible opportunity be placed in classes and involved in instruc- tional programs that are best prepared to meet their needs. This shall be done following careful study made by June 1 for at least ninety percent (90%) promptly upon indication of need therefor of the number characteristics, development and unique problems of the child requiring special attention. The combined judgment of the Principal and teacher or teachers estimated involved shall be added to be needed the diagnosis and prescriptive information provided by the school psychologist in order to help in determining the best possible placement for the programchild.
(d) Teachers 13. The School District and the Federation agree that the extension of psy- chological testing, counseling, and attendance services to kindergartens is xxxxx- able. The School District will be provided make every effort to plan a choice of schools and, where administratively program for providing these services.
14. Where possible, that choice will children shall be honored placed in making assignmentsan appropriate setting within thirty (30) days of the receipt of a psychological evaluation.
(e) Seniority 15. When, in summer school the opinion of a teacher, the assignment of a child to a special class warrants a re-evaluation, the request of the teacher for such a re- evaluation shall govern when it becomes necessary to reduce positionsreceive expedited attention. Where such summer school seniority When the re-evaluation is equalmade, then systemwide seniority the teacher shall applybe involved.
(f) Information regarding the number of allotted positions by level and sub jects as well as teachers appointed to such positions shall be made available to the Federation on a timely basis.
(g) Additional appointments to summer school shall be made as needed dur ing the summer school sessions in accordance with subsection (b) of this Article16. If a list is exhaustedchild exhibits anti-social behavior, then teachers certified in that subject and on another current summer school list (though not appointed from it) such essential information shall be given recorded in the opportunity pupil pocket and maintained for a period of eighteen (18) months if the pupil has not exhibited similar and/or related behavior. Such information should be considered relevant to fill decisions by teachers and admin- istrators regarding the position appropriateness of additional supports or alternative placement.
17. To the extent practical, each school shall establish an in-house “accom- modation” room for disruptive students who are removed temporarily from their classrooms.
18. Pupils shall not be assigned to the school library or instructional materi- als center as a temporary appointeedisciplinary measure.
19. If Health information for shared-time students shall be forwarded to the name of such temporary appointee is reached on receiving school by the eligibility list for a regular appointment, they shall continue in home school.
20. The School District will give every consideration to the temporary position for the duration achievement of the summer session. However, their seniority for summer school purposes, Parties’ goal to have art and music instruction available in the subject of the eligi bility list shall begin from the date their name was reached on such eligibility listall grades.
(h) A summer school teacher may take an unpaid leave of absence for up to two (2) xxxxxxx if they are on sabbatical leave from regular school. A teacher taking such leave of absence shall retain their position and continue to accrue seniority and all other benefits as though they were teaching.

Working Conditions of Teachers. (b) If the Principal and the Building Committee have not reached consensus on a Master Schedule/Roster for the school by May 25, the Principal and Building Committee shall not later than five (5) working days after May 25 submit to the Federation-District Committee a memorandum that describes areas of consensus and defines issues on which they continue to differ.
(c) Notification The Principal may implement a design that includes the areas of appointment to summer school shall be made by June 1 for at least ninety percent (90%) consensus with the Building Committee unless the Federation-District Committee con- cludes that the design does not reasonably satisfy the above-stated criteria, in which case the School District members of the number of teachers estimated Committee shall work with the Principal to be needed for the programdesign an appropriate Master Schedule/Roster.
(d) Teachers will Notification of his/her proposed grade or class assignment for the following school year shall be provided given to each teacher at as early a choice of schools and, where administratively possible, that choice will be honored in making assignmentsdate as possible after allotments are complete.
(e) Seniority in summer In middle and senior high schools by June 15 or the last day of school, whichever is earlier, tentative rosters shall be distributed to the individual teach- ers. If changes are made between tentative rosters and final rosters, any teachers concerned shall be notified. In addition to the Building Committee, any interested teacher from that particular school shall govern when it becomes necessary to reduce positions. Where such summer school seniority is equal, then systemwide seniority shall applymay examine the organization plan.
(f) Information regarding In elementary schools by June 15 or the number last day of allotted positions by level and sub jects as well as school, whichever is earlier, teachers appointed to such positions shall be made available to the Federation on a timely basisnotified of what grades and sections they will teach and every teacher will receive his/her tentative new class name list, including each pupil’s reading level.
(g) Additional appointments During the summer when the roster is actually being constructed, any teacher, as well as members of the Building Committee, may come to summer the school to review and discuss the roster with the administrator in charge as it is being constructed.
(h) The master roster shall be made as needed dur ing posted in each school.
(i) A teacher may, with his/her consent, be assigned to more than five (5) periods of teaching a week outside of his/her field of appointment.
(j) In departmentalized schools, rostering practices shall include a limitation on the summer school sessions in accordance number of grade levels or subjects and the number of tracks within grade level or subject to be taught. The number of grade levels or subjects to be taught shall be limited to three (3). The number of different lessons to be prepared according to grade level and type of class within the grade level shall be limited to four (4), except where the number of specialized subject area teachers assigned to a department makes such limitations impossible.
(k) To the extent administratively possible, a teacher with subsection (b) of this Article. If a list is exhausted, then teachers certified in that subject and on another current summer school list (though not appointed from it) appropriate quali- fications shall be given the opportunity to fill teach classes of varying grade and achievement levels. In addition, special consideration shall be given to rosters assigned to new teachers so that new teachers are not assigned to teach the position as a temporary appointee. If most challenging classes or the name of such temporary appointee is reached on the eligibility list for a regular appointment, they shall continue in the temporary position for the duration of the summer session. However, their seniority for summer school purposes, in the subject of the eligi bility list shall begin from the date their name was reached on such eligibility listmost difficult students.
(hl) A summer school Student teachers shall not be assigned to any teacher may take an unpaid leave who has less than three (3) years of absence teaching experience and who does not hold provisional or permanent certification for up to two (2) xxxxxxx if they are on sabbatical leave from regular school. (im) A summer Middle school teacher and high school teachers shall not be permitted, during the summer session, rostered to use sick leave accumulated during the regular school year.
