WORKPLACE INSURANCE. 16.01 All nurses included in this Agreement shall continue to be covered by the provisions of the Workplace Safety & Insurance Act. 16.02 The Employer and the Union agree that they mutually desire to maintain standards of safety and health in order to prevent accidents, injury and illness. (a) A nurse who is incapacitated and unable to work as a result of an accident sustained while on duty in the service of the Employer within the meaning of the Workplace Safety & Insurance Act, shall continue to receive her regular salary from the Employer, less regular deductions, during the waiting period, provided she assigns over to the Employer her compensation payments due from Workplace Insurance for such period. (b) A nurse who elects not to assign her Workplace Insurance payments to the Employer may make prior arrangements for the prepayment of the full premium of any contributory health benefit plans. 16.04 Should the nurse's claim be disallowed by the Workplace Insurance Board, then any monies paid by the Employer shall be either charged against the nurse's accumulated sick leave credits, or if the nurse has no sick leave credits, the amount so paid shall be recovered from the nurse. 16.05 When a nurse is absent on a Workplace Insurance claim, all benefits of this Agreement will continue to accrue subject to Article 16.06 below, until the nurse is declared permanently unfit to perform her regular duties. 16.06 A nurse who is absent on a Workplace Insurance claim will not accrue annual vacation and will not be paid for designated named holidays with pay during the entire period of absence. However, service credits for the purpose of calculating future vacation entitlement will continue to accrue during such absence. (a) A nurse who has been on staff for more than one (1) year and is declared unfit to perform the essential duties of her regular job shall lose her seniority and employment two (2) years after the date of the accident or one (1) year after the “Notice of Fitness of Essential Duties” from the Workplace Safety & Insurance Board has been received, whichever occurs first. Seniority and employment shall also be lost on the date as of which a nurse is certified fit to return to work and she fails to do so or in case of a term employee upon the expiration of such term. Subject to any other statute that may supersede this Collective Agreement. (b) A nurse who is absent on Workplace Insurance leave and who has been on staff for less than one year may be terminated on the date she is declared unfit to perform the essential duties of her regular job, subject to any other statute that may supersede this Collective Agreement.

(a) A nurse who has been on staff for more than one (1) year and is declared unfit to perform the essential duties of her regular job shall lose her seniority and employment two (2) years after the date of injury or the accident or one date of a recurrence of the injury that has been approved by WSIB under the initial claim, and b) not result in reductions in benefits to the employee under the Supplemental Group Medical Benefits Plan, the University Dental Plan, the University Eye Care Plan, the University Group Life Insurance Plan, the University Pension Plan, and (when applicable to an employee) the University Long Term Disability Plan for a period of one (1) year after following the “Notice date of Fitness injury or the date of Essential Duties” from a recurrence of the injury that has been approved by WSIB under the initial claim, on the condition that the employee continues to maintain his share of contributions to benefits. In the second year following the date of injury, the employee may choose to maintain any or all of the aforementioned benefits on the condition that he pays 100% of the premiums or contributions to the plans which he chooses to maintain and provided that the benefit plans so permit. It is agreed that "date of injury" has the same meaning as "date of injury" as defined in the Workplace Safety & and Insurance Board Operational Policy #9.10. 2. The University will provide the employee with a copy of the WSIB Employer's Report of Injury/Disease (Form 7). 3. Provided that the employee is entitled to loss of earnings (XXX) benefits from the WSIB, the University agrees that an injured/ill employee is entitled to a percentage of his pre-injury net wages, as determined by the WSIB, while he is absent from work on an approved claim relating to a compensable injury or occupational disease. 4. After a claim has been receivedsubmitted to the WSIB for XXX benefits, whichever occurs firstan employee will be allowed to use accumulated sick leave credits to cover the entire absence or some portion of the absence. Seniority An employee may, at his discretion, choose to cover an additional portion of the absence through the application of vacation, overtime or other credits, once sick leave credits have been exhausted. An employee who has sick leave, vacation, overtime or other credits will be advanced an amount equal to 100% of his gross earnings. On approval of the claim for temporary benefits: a) an amount equal to the reimbursement paid to the University by the WSIB with respect to the claim will be credited back to the employee's sick leave, vacation, overtime or other credits, as applicable, and b) while the absence continues, an amount equal to the difference between the WSIB daily XXX rate and employment shall also the employee's daily pay rate (i.e. a "top-up") will be lost debited from the employee's sick leave credits. An employee may, at his discretion, choose to have the "top-up" debited from vacation, overtime or other credits, once sick leave credits have been exhausted. Once the discretionary credits of the employee's choice have been exhausted, the employee will be placed on a leave of absence without pay from Lakehead University, and will be paid directly by the WSIB once the claim for XXX benefits has been approved. Once an employee has been placed on a leave of absence without pay, he will remain on the date as leave of which a nurse absence without pay until he is certified fit able to return to work and she fails to do so suitable, alternative or in case of a term employee upon the expiration of such term.
