XXXXXXX OF EMPLOYMENT CONTRACT. Pursuant to Education Code section 35031, BOARD shall notify SUPERINTENDENT at least forty-five (45) days prior to the expiration of this CONTRACT of BOARD’s decision as to whether to renew this CONTRACT. SUPERINTENDENT shall notify BOARD in writing of this requirement no later than the date of the last regular BOARD meeting in March of the year in which this CONTRACT is due to expire. If for any reason the scheduling and/or cancellation of BOARD meetings prevent compliance with this requirement, SUPERINTENDENT shall nevertheless be required to provide BOARD with the written notice set forth herein at least ninety (90) days prior to the expiration of the CONTRACT. Failure by the SUPERINTENDENT to comply with the notice requirements set forth herein may, within the discretion of the Board, be deemed to be a breach of this CONTRACT within the meaning of Article XI (F) herein.

The term “Period of Employment” shall include any extension thereof pursuant to the preceding sentence. Provision of notice that the Period of Employment shall not be extended or further extended, as the case may be, shall not constitute a breach of this Agreement and shall not constitute “Good Reason” for purposes of this Agreement. Notwithstanding the foregoing, the Period of Employment is subject to earlier termination as provided below in this Agreement.

  • Engagement of Employees 8.1.1 All prospective Employees may be required to complete an Application for Employment form prior to engagement. Applicants may be required to undertake a pre-employment physical/medical assessment, the cost of which will be borne by the Company. Any Employee who knowingly provides false information in their application or in the medical may be dismissed.

  • Employment Contracts Neither the Seller nor any Seller Subsidiary is a party to any Contracts for employment, severance, consulting or other similar agreements with any employees, consultants, officers or directors of the Seller or any of the Seller Subsidiaries, except as set forth on Section 2.10(h) of the Seller Disclosure Schedule. Neither the Seller nor any Seller Subsidiary is a party to any collective bargaining agreements.

  • Summer Employment 26.1 In selecting teaching staffs for summer programs, employment shall be offered to teachers who are certified and “Highly Qualified” in the subject area(s).
