Xxxxxxx’x Representative. Xxxxxxx’x Representative shall be responsible for providing Bechtel-supplied information and approvals in a timely manner to permit Vendor to fulfill its obligations under the Contract Documents. Xxxxxxx’x Representative shall also provide Vendor with prompt written notice if it observes any failure on the part of Vendor to fulfill its contractual obligations, including any errors, omissions or defects in the Contract Documents or the performance of Vendor’s Scope of Work; provided however, that in no event shall Xxxxxxx’x failure to observe or notify Vendor of any failures, errors, omissions or defects with respect thereto relieve Vendor of its obligation to remedy the same. Xxxxxxx’x Representative shall be vested with the authority to act on behalf of and bind Bechtel.

Xxxxxxx’x Representative. XXXXXXX shall designate a representative authorized to act on XXXXXXX'x behalf with respect to the MWTS Project (the "XXXXXXX Representative"). XXXXXXX or the XXXXXXX Representative shall examine documents submitted by SIONIX and shall render decisions in a timely manner (not to exceed two (2) business days after receipt of a written request for decision unless otherwise approved by SIONIX in writing) and in accordance with the schedule accepted by XXXXXXX. XXXXXXX may obtain independent review of the Contract Documents by a separate architect, engineer, contractor or cost estimator under contract to, or employed by XXXXXXX. Such independent review shall be undertaken at XXXXXXX'x expense in a timely manner (not to exceed two (2) business days after receipt of written request for decision) and shall not delay the orderly progress of the Work. XXXXXXX shall use its commercially reasonable best efforts to require any consultant engaged by XXXXXXX to execute the SIONIX Confidentiality and Nondisclosure Agreement.
