Your Duty of Care. All Customers – You must take reasonable care to provide complete and accurate answers to the questions we ask you when you take out, make changes to or renew your policy. If you are in doubt, please contact us. Insurance is based on the information that you give to the insurer and if this information is wrong or incomplete, claims may not be paid in full or at all, your policy may be cancelled, have special terms imposed, policy voided, and the premium may not be returned. Commercial Customers only – If you are purchasing Insurance for purposes related to your trade, business or profession: In addition to the above, you must disclose all facts material to the insurance you wish to take out. The facts you need to reveal are all those which the insurer needs to estimate your risk and set the premium and terms. You must disclose this information in a way that is clear and substantially correct. You must also inform us of any changes to your policy details during the life of your policy, including at renewal. Please read carefully all policy documents sent to you and inform us immediately of any incorrect information shown. If you have difficulty in understanding anything, please let us know and we will assist you. For your protection, insurers maintain databases to prevent fraud and the information you give us may be subject to checks.

Your Duty of Care. 5.1 You must tell us if your home or the block where you live is damaged. You must also tell us about any defects, faults or problems likely to cause injury to people or damage to our property.
Your Duty of Care. You agree to: ⯈ maintain procedures and controls to detect and prevent thefts of Instruments or losses due to fraud or forgery involving Instruments; ⯈ maintain procedures and controls in connection with anti-money laundering and anti-terrorist financing commensurate with your business and in compliance with all Applicable Law and to provide evidence of same to us upon request; ⯈ diligently supervise and monitor the conduct and work of all Authorized Signatories and all agents and employees having a role in the preparation of your Instruments and your bank statement reconciliation or other banking functions; and ⯈ verify the authenticity and validity of all Instruments deposited to and drawn on your Account. You acknowledge and agree that we will have no responsibility or liability whatsoever for any loss due to a forged or unauthorized signature unless the loss was caused solely by our gross negligence, fraud or willful misconduct.

We shall have no responsibility or liability whatsoever for any loss due to a forged or unauthorized signature unless: • the forged or unauthorized signature was made by a person who was at no time your agent, employee or Authorized Signatory; • the loss was unavoidable despite you having taken all feasible steps to prevent loss arising from forgery or unauthorized signatures; • the loss was unavoidable despite you having in place the procedures and controls to supervise and monitor your agents, employees and Authorized Signatories; and • the loss was caused solely by our gross negligence, fault or wilful misconduct.
Your Duty of Care. You will maintain commercially reasonable procedures and controls to detect and prevent thefts of Instruments or losses due to fraud, forgery or unauthorized use involving Instruments. You will diligently supervise and monitor the conduct and work of all Authorized Signatories and all agents and employees having a role in the preparation, handling or review of your Instruments and your bank statement reconciliation or other banking functions. We shall have no responsibility or liability whatsoever for any loss due to any altered, forged, fraudulent or unauthorized Instrument, even if you notify us within the Review Period, if: · the altered, forged, fraudulent or unauthorized Instrument was made by a person who was at any time your agent, employee or Authorized Signatory; or · the loss could have been avoided by your having taken commercially reasonable steps to prevent losses arising from altered, forged, fraudulent or unauthorized Instruments; or · the loss could have been avoided by your having in place commercially reasonable procedures and controls to supervise and monitor your agents, employees and Authorized Signatories; except, in each case, to the extent the loss was caused by our gross negligence or wilful misconduct.

Related to Your Duty of Care

  • Standard of Care In the absence of willful misfeasance, bad faith, gross negligence or reckless disregard of obligations or duties hereunder on the part of the Sub-Advisor, the Sub-Advisor shall not be subject to liability to the Advisor, the Trust or to any shareholder of the Portfolio for any act or omission in the course of, or connected with, rendering services hereunder or for any losses that may be sustained in the purchase, holding or sale of any security.

  • QUALITY OF CARE (a) The SUDRF shall assure that any and all eligible beneficiaries receive substance use treatment that complies with the standards in Article 3.3, above, and the TRICARE/CHAMPUS Standards for Inpatient Rehabilitation and Partial Hospitalization for the Treatment of Substance Use Disorders.

  • Duty of Confidentiality Licensee will protect the TCK as Oracle Confidential Information protected under this Section 6.0. A party receiving Confidential Information may not: (i) disclose Confidential Information to any third party, except that such party may exchange comments or questions concerning its use or the results of using the TCK, including relevant excerpts of the TCK, provided such TCK excerpts are inherently part of such results, but not the non-relevant portions of the TCK itself, or (ii) use Confidential Information except for the purpose of developing and testing Products. The receiving party will protect the confidentiality of Confidential Information to the same degree of care, but no less than reasonable care, as such party uses to protect its own Confidential Information. Obligations regarding Confidential Information will expire three (3) years from the date of receipt of the Confidential Information, except for source code, which will be protected by Licensee in perpetuity.
