Protection of personal data. 9.1. The Provider processes the personal data of the Client and the Service Recipient as the data controller within the meaning of Art. 4 (7) of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (the “GDPR”) (the alespoň na některém z následujících právních základů: • smluvní vztah, který je tvořen Smlouvou a OP, tj. právní základ dle ust. čl. 6 odst. 1 písm. b) GDPR; • zákona č. 372/2011 Sb., o zdravotních službách a podmínkách jejich poskytování, ve znění pozdějších právních předpisů (dále jen „Zákon o zdravotních službách”) tj. právní základ dle ust. čl. 6 odst. 1 písm. c) GDPR, • souhlas se zpracováním osobních údajů (pokud je ze strany Klienta nebo Příjemce služeb udělen), tj. právní základ dle ust. čl. 6 odst. 1 písm. a) GDPR.

The obligation to provide information to Buyer within the meaning of Article 13 of Regulation 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) ( hereinafter referred to as the “GDPR Regulation”) related to the processing of Buyer's personal data for the purposes of fulfilling Purchase Agreement, for the purposes of negotiating Purchase Agreement and for the purposes of fulfilling the public law obligations of Seller, is carried out by Seller by completing special document.
Protection of personal data. 1. The Trader processes the personal data of the Partners in accordance with the GDPR and Act No. 110/2019 Coll., on the Processing of Personal Data, as amended and effective, while respecting the principles of legality, fairness, transparency, purpose limitation, data minimization, accuracy, storage restrictions, integrity, and confidentiality.

The Provider processes the personal data of the Client and the Service Recipient as the data controller within the meaning of Art. 4 (7) of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (the “GDPR”) (the “Controller”), this always being at least on one of the following legal bases: • the contractual relationship which is constituted by the Agreement and the BTC, i.e. the legal basis pursuant to the provisions of Act. 6 (1) b) of the GDPR; • Act No. 372/2011 Coll., on medical services and conditions of their provision, as amended (the “Act on Medical Services”) i.e. the legal basis pursuant to the provisions of Art. 6 (1) c) of the GDPR, • consent to processing of personal data (if given by the Client or the Service Recipient), i.e. the legal basis pursuant to the provisions of Art. 6 (1) a) of the GDPR. 9.2. The Controller is obliged to process or otherwise handle the personal data of the Client or the Service Recipient in compliance with the GDPR, Act No. 110/2019 Coll., on Personal data processing, the Act on Medical Services and in
Protection of personal data. Within the MCS portal, the operator is also the processor of personal data, i.e. he is entitled to collect, process and store personal data of users in a range that is necessary exclusively for the purposes of providing services. The operator has adopted all measures, particularly organizational, technical and staffing measures, which ensure harmony between providing services and the currently valid and effective legislation related to the protection of personal data and to the protection of other data, which are stored in the MCS portal. The user can be approached by the operator for granting consent with the processing of personal data even for different purposes, however, it has to be in accordance with the currently valid and effective legislation that is related to the protection of personal data. Personal data can be also processed by entities, which have signed a written contract regarding the processing of personal data with the relevant controller of personal data.
