Accepted Product definition

Accepted Product means, (a) in general, (i) physical and financial power, power basis, natural gas, natural gas basis, heat rate and natural gas tolling, (ii) options on the foregoing, (iii) weather derivatives, ancillary services, capacity, transmission congestion rights, transmission reassignment and renewable energy credits, and (iv) other physical or financial structured products related to the hedging of retail electricity, as such other structured products may be approved by the Sleeve Provider, including in such approval such related changes to the terms and conditions of this Agreement as the Merrill Parties deem appropriate (including the addition of related Counterparty Limitations in respect of such products), but with approval of such other structured products not to be unreasonably withheld, conditioned or delayed unless the impact thereof on all applicable Risk Limits is not measurable using the methodology employed on Schedule 1.01(c) or, in the case of products traded on an Accepted Exchange, such products are not capable of being assigned to the Sleeve Provider in connection with the execution of a related over the counter trade between the Sleeve Provider and REPS in a manner similar to that as provided in Section 2.03, in the Sleeve Provider’s reasonable discretion, and (b) in respect of each Accepted Counterparty, each of the foregoing with respect to such Accepted Counterparty set forth on Exhibit B; provided that (x) all Accepted Products shall be reasonably related to the Approved Market and (y) all Accepted Products shall have, with respect to all transactions other than those in the following proviso, a “tenor: of no more than 5 years and 6 months, meaning the time between the date of the execution of the transaction until the final delivery date of such product for physical transactions or the last day of the final settlement period for financial transactions, provided that (i) all transactions entered into on or after the Third A&R Date shall have a “tenor” of no more than 30 months and (ii) any transaction entered into in connection with the fixing of pricing under a corresponding C&I Contract may have a tenor ending not later than the last day of the scheduled term of such C&I Contract.
Accepted Product has the meaning set forth in Section 6.4(a).

Examples of Accepted Product in a sentence

  • Accepted Product lots shall be stored in a clean and safe condition by Seller at Seller's Plant or any other mutually acceptable location until Buyer requests shipment of individual Products to Buyer's Plant.

  • Subject to Section 2.5.3, the Development Program shall expire upon either of the earlier 1) the date Relief selects Accepted Product Concepts for further development and commercialization; or 2) One hundred and eighty days (180) days following the delivery of Final Report.

  • In addition to the restriction set out in Section 4.1 below, InveniAI shall not, itself or through any of its Affiliates or any Third Party, research, develop, make, use, market, license, offer to sell, sell or otherwise commercialize any such Relief IP, including the Accepted Product Concepts and any subject matter related to Accepted Product Concepts in the Final Report, and the Final Report’s core content regarding the Product Concepts (API-disease combinations).

  • If Buyer orders Products from Seller by accepting in writing (and by the deadline set forth above) Seller’s estimate, Seller shall be deemed to have accepted Buyer’s Product Order in writing on the date Buyer delivers Buyer’s written acceptance of Seller’s estimate to Seller, and an Accepted Product Order shall exist as of that date.

  • However, we may destroy any Accepted Product at any time following the date ninety days after our receipt of the Accepted Product.

  • Unless and until Buyer and Seller execute a change order reflecting the change in quantity and, if applicable, change in Contract Price, and Seller receives any additional deposit as set forth in the change order, Seller shall have no obligation to provide any quantity of Product or Products different from the amounts specified in the original Accepted Product Order.

  • Each counterparty listed on Exhibit B shall constitute an Other Accepted Counterparty and the limitations set forth therein shall constitute such Other Accepted Counterparty’s “Counterparty Limitations” (in respect of each Accepted Product set forth therein).

Related to Accepted Product

  • Finished Product means a cannabis product in its final form to be sold at a retail premises.

  • Approved Product means any water fitting, plumbing product, material or component which is the subject of an existing WRAS Approval;

  • Drug Product means a specific drug in dosage form from a known source of manufacture, whether

  • Marihuana-infused product means a topical formulation, tincture, beverage, edible substance, or similar product containing marihuana and other ingredients and that is intended for human consumption.

  • Aerosol Product means a pressurized spray system that dispenses product ingredients by means of a propellant contained in a product or a product's container, or by means of a mechanically induced force. “Aerosol Product” does not include “Pump Spray.”

  • Designated Products means products provided by Motorola to Licensee with which or for which the Software and Documentation is licensed for use.

  • Final Product means a reasonably homogenous cannabis product in its final packaged form created using the same standard operating procedures and the same formulation.

  • Commercial Product means any such product as defined in FAR 2.101.

  • Licensed Product means a product or part of a product in the Licensed Field of Use: (A) the making, using, importing or selling of which, absent this license, infringes, induces infringement, or contributes to infringement of a Licensed Patent; or (B) which is made with, uses or incorporates any Technology.

  • Competing Product means [***].

  • Finished Products means any one or more of the following petroleum oils, or a mixture or combination of these oils, to be used without further processing except blending by mechanical means:

  • Aerosol coating product means a pressurized coating product containing pigments or resins that dispenses product ingredients by means of a propellant, and is packaged in a disposable can for hand-held application, or for use in specialized equipment for ground traffic/marking applications.

  • New Product means the Synology-branded hardware product and Synology-branded accessories contained in the original packaging Customer bought from an authorized Synology distributor or reseller. You may see our “New Product” at Product Support Status.

  • regulated product means a consumer product for which a VOC standard is specified in section 94509(a), and

  • Replacement Product means electric generating capacity, capacity-related benefits, environmental attributes, Energy or other electric products from a generation resource other than the Facility that are provided or delivered to replace or substitute for Contract Capacity or Storage Capacity (or any Capacity-Related Benefit, Environmental Attribute, Other Electric Product, Contract Energy, or Storage Energy associated therewith), in each case, in whole or in part, pursuant to Section 4.6.

  • Bundled Product means Product sold together with any other product(s) or service(s) at a single unit price, whether packaged together or separately, and which other product(s) or service(s) have material independent value from Product itself.

  • Collaboration Product means a pharmaceutical product containing or comprising Compound in any dosage form alone, or in combination with, one or more other pharmaceutically active ingredients, and any and all Improvements thereto.

  • Marijuana-infused products means products that contain marijuana or marijuana extracts and are intended for human use. The term "marijuana-infused products" does not include useable marijuana.

  • Pharmaceutical Product shall have the meaning ascribed to such term in Section 3.1(hh).

  • Competing Products means any product or service in existence or under development that competes with any product or service of the Company Group about which the Participant obtained Confidential Information or for which the Participant provided advisory services or had sales, origination, marketing, production, distribution, research or development responsibilities in the last twenty-four (24) months of employment with the Company Group.

  • Edible cannabis product means cannabis product that is intended to be used, in whole or in part, for human consumption, including, but not limited to, chewing gum, but excluding products set forth in Division 15 (commencing with Section 32501) of the Food and Agricultural Code. An edible cannabis product is not considered food, as defined by Section 109935 of the Health and Safety Code, or a drug, as defined by Section 109925 of the Health and Safety Code.

  • Nicotine product means a product that contains nicotine and is not any of the following:

  • Spray buff product means a product designed to restore a worn floor finish in conjunction with a floor buffing machine and special pad.

  • Combination Product means any combination of the Product with one (1) or more other active ingredients, products or services that is not the Product, where such products are sold either as a fixed dose/unit or as separate doses/units in a single package for a single price.

  • Hemp product means the same as that term is defined in § 3.2-4112.
