Subject to performance of each Owner’s obligation to make or cause to be made the dedications of Public Active Open Space described in the Development Guide Agreement at the time of subdivision platting of each portion of that Owner’s property containing Public Active Open Space, the Town shall not impose any additional open space dedications or payments in lieu thereof for any portion of the FDP Properties.
Recreational facilities within the Active Open Space, including parking lots and restrooms, and all utilities and infrastructure shall be a Use by Right.
